[Last Edit: vermont2nd]
I am wondering if there was an easy was to start a thread (maybe I just did it) to have a list of the States that restrict or prohibit AR15 variant or "Assault" pistols. I am curious which States I should not or cannot travel to with an AR15 pistol.
Maybe for now we could just hit reply (without a quote), and see if that works. I will keep a running list and then post it at some point in the next few days/weeks. If one member posts something and someone thinks it may be incomplete or incorrect please speak up. We want to end up with a peer reviewed list with at least two members from each state agreeing. Also let us know if there is any upcoming legislative changes on the horizon that we need to track. I'm guessing that we will not get replies from members in prohibited states, because they don't build pistols and don't read this forum, but if we had a list of good-to-go states that would be a start. I will start. Florida: NKR (no known restrictions) edited to make the thread title bold. ~vermont2nd |

OK, we have 44 page views and 4 posts. Obviously there is a lot of interest but not a lot of people that feel that they are knowledgeable about their states laws. Even more reason for this thread. Just get r done!

You definitely DO NOT want to travel to Hawaii with an AR pistol. It's considered an assault pistol and is illegal.

Ohio and Illinois are both good to go at a state level. Illinois has some municipal restrictions in the Chicago area.

What the hell is your "selective degree of validity"?
And what is this no known restrictions? They are either GTG or not, there is no gray. In Tennessee they are 100% legal and are considered pistols. They can be bought in almost any gun shop. They can be carried open or concealed with a handgun carry permit. How can that be any degree of validity except 100% legal. If your going to get a list, make it yes or no. Don't put questionable validity at all in it, all that does is raise the question whether it is legal or not. The same question your trying to answer. |

I agree with, iNeXile556, saying, "No Known Restrictions (NKR)," makes it ambiguous, leaving it open as to whether there may possibly be restrictions that just aren't known. I can say definitively that there are no restrictions on AR pistols in Vermont.

This is a work in progress. I need everyone to review what I post and recommend changes.
First, This is my first time doing something like this and with everyones help we can come up with a valid list. I don't know what state laws are, so one someone says GTG if registered, I don't know what that means. are all handguns registered or just AR15 variant pistols? When people say things like...as far a I know they are good to go. I think they are OK. then I didn't give the state a NKR or what we will not change to GTG I was hoping to get 2 GTGs for each state before I declared a state GTG. So, help me do this. Don't use I THINK and don't tell me they need to be registered without explaining. I will listen to any input as to how to do this better. Just Sayin! |
|
|
OK, bases upon you comments I have dropped the NKR term and used GTG. I need two members from each state to provide input before I list a state as GTG. I THINK, MAYBE, and AS FAR AS I KNOW statement do not give me a lot of comfort. If your state is GTG then tell me so I can anotate it appropriatly. As soon as I get two members stateing that their state is GTG I will mark it accordinly but I still want everyone to provide info about any known restrictions.
If this isn't going to work we will just make it go away. NOTICE:
PLEASE READ THE NEW PROCEDURE! Now that this is rolling, I want to give our members ownership. Kind of like Wikipedia. Anyone who is confident in their knowledge of their state's laws is welcome to edit the list personally. Just "copy" the list and "paste" it into a new post. Edit the list appropriately and submit it. I can't get the columns to line up so you can work on that. Fell free to remove my validity rating and if you are sure about your laws then list your state as GTG and don't wait on a second member. If anyone sees any errors, please comment and discuss. If you change something you could leave a note as to why you changed it. I thought this was going to be easy and I could get some valid per reviewed information but some wanted instant gratification. I updated the list through today, Sunday the 28th 1638 EDT with all the information you have provided me to this point. Just Sayin! |

West Virginia GTG http://www.wvago.gov/pdf/BookletWVFirearmLaws.pdf
It is important to note that while West Virginia is an “open carry” state the ability to carry openly is
deemed by law enforcement to apply only to West Virginia residents. West Virginia law enforcement’s interpretation of “open carry” is that the handgun must be visible from three sides. Take a look at this list and you'll realize that an AR pistol fits just about every definition of "assault pistol" in Hawaii. I also don't think that a bullet button will fly as the magazine will be "outside or the pistol grip" "Assault pistol" means a semiautomatic pistol which accepts a detachable magazine and which has two or more of the following characteristics:
(1) An ammunition magazine which attaches to the pistol outside of the pistol grip; (2) A threaded barrel capable of accepting a barrel extender, flash suppressor, forward hand grip, or silencer; (3) A shroud which is attached to or partially or completely encircles the barrel and which permits the shooter to hold the firearm with the second hand without being burned; (4) A manufactured weight of fifty ounces or more when the pistol is unloaded; (5) A centerfire pistol with an overall length of twelve inches or more; or (6) It is a semiautomatic version of an automatic firearm; but does not include a firearm with a barrel sixteen or more inches in length, an antique pistol as defined in this section or a curio or relic as those terms are used in 18 United States Code §921(16) or 27 Code of Federal Regulations 178.11. |

None of the list of evil features matters if the pistol doesn't have a detachable magazine; it must have both a detachable magaizne AND two or more of the features. California's assault weapon laws are similar: 12276.1. (a) Notwithstanding Section 12276, "assault weapon" shall also mean any of the following: (1) A semiautomatic, centerfire rifle that has the capacity to accept a detachable magazine and any one of the following: (A) A pistol grip that protrudes conspicuously beneath the action of the weapon. (B) A thumbhole stock. (C) A folding or telescoping stock. (D) A grenade launcher or flare launcher. (E) A flash suppressor. (F) A forward pistol grip. (2) A semiautomatic, centerfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds. (3) A semiautomatic, centerfire rifle that has an overall length of less than 30 inches. (4) A semiautomatic pistol that has the capacity to accept a detachable magazine and any one of the following: (A) A threaded barrel, capable of accepting a flash suppressor, forward handgrip, or silencer. (B) A second handgrip. (C) A shroud that is attached to, or partially or completely encircles, the barrel that allows the bearer to fire the weapon without burning his or her hand, except a slide that encloses the barrel. (D) The capacity to accept a detachable magazine at some location outside of the pistol grip. It's identical wording, and bullet buttons were ruled a legally acceptable means of converting an AR from a weapon that accepts a detachable magazine to a weapon that does not accept a detachable magazine. This is why it's a "possible" loophole, because Hawaii, although also in the 9th circuit with California, may not accept bullet buttons as California does. California may also allow AR pistols with bullet buttons. I'm not quite as well versed with Cali law as Hawaii law, so I'd like a second opinion on that. But it seems like AR pistols are ok in Cali with bullet buttons. * Do not take any of my posts as legal advice. If I lived in Hawaii at the moment, I would not risk using an AR pistol with a bullet button, even though it may be legal, it's a gray area. |

Mass has an assault weapon ban that IIRC includes pistols over 50oz?
The only exception to the ban is it must have been owned prior to 1994 (even though the law was written well after 1994 I wouldn't want to be the test case). It also doesn't state owned in Mass or just owned/possesed somwhere (basically manufactured prior to 1994?) I live in Mass and have owned my OA93 since just before the national AWB of 1994. If you do not live in Mass and posess a LTC A (large capacity firearm license) I wouldn't suggest taking ANY firearm to Mass. |

There isn't any precedence, so you may end up being the test case. Obligatory IANAL :) |

Virginia is GTG, with the following provisions:
* Non-(concealed handgun carry permit) holders can only purchase 1 handgun a month. (Unless they file a separate form with the State Police.) * It’s a crime to provide a person under 18 with an assault firearm and they shall not possess or transport a handgun or assault firearm. (Unless under adult supervision.) * A non-citizen or alien not admitted for permanent residence shall not possess or transport an assault firearm, and a gun dealer shall not transfer it to such person. * Any person with a concealed handgun permit may carry a concealed handgun onto school property while in a vehicle to drop off or pick up a child, only if the permit holder remains in the vehicle with the handgun COMPLETELY concealed. (My emphasis, you can’t camouflage the buffer tube as a tennis racket grip.) NOTE: “Assault firearm” means any semi-automatic center-fire rifle or pistol which is equipped with a magazine which will hold more than twenty rounds of ammunition or designed by the manufacturer to accommodate a silencer or equipped with a folding stock. |

California still has the Assult Weapon ban in place. AR15 "pistols" are sold as single shot only. You CAN NOT build a AR15 pistol with a stripped lower. A stripped lower can only be DROSed as a long gun. You can home build a AR15 pistol with a 80% lower if you follow some common sense rules. Most "AR" type firearms will have a bullet button. It's very difficult to understand California's current firearms rules and regulations and gun stores may not give out correct information. If you live in Ca you already know this and wish you lived somewhere else. 10 round mag limit, BB's, NO silencers, NO SBR's, NO CCW, NO fun.... So I would be very cautious if you came into the state with your AR15 pistol from say...Arizona, it's not legal here.
