(a)

As used in this chapter -

The term ''semiautomatic assault weapon'' means -

(C)

a semiautomatic pistol that has an ability to accept a detachable magazine and has at least 2 of -

(i)

an ammunition magazine that attaches to the pistol outside of the pistol grip;

(ii)

a threaded barrel capable of accepting a barrel extender, flash suppressor, forward handgrip, or silencer;

(iii)

a shroud that is attached to, or partially or completely encircles, the barrel and that permits the shooter to hold the firearm with the nontrigger hand without being burned;

(iv)

a manufactured weight of 50 ounces or more when the pistol is unloaded; and

(v)

a semiautomatic version of an automatic firearm;[/blue]

Based on the text of the law, it is impossible to assemble a legal post-ban AR pistol using standard AR components that would meet the weight requirements (the gun you pictured would weigh around 75oz.)  There are two post-ban AR pistols that I'm aware of:

- The problem-plagued Professional Ordnance Carbon 15 Pistol, which uses carbon fiber receivers and a number of custom parts to make weight.

- The Olympic Arms OA-98, which uses a custom upper with integral buffer system, and is drilled all over with holes to save weight.

Olympic also made a pistol with a fixed 30-round mag that could have the other bad features, since the fixed mag exempted it from AW status.

Note too that you can only make a pre-ban pistol from an existing pre-ban pistol.  A pre-ban AR that was built into a rifle can never be made into a pistol, and a stripped lower can't have been a pre-ban, so this kit could only be legally used to reconfigure an existing pre-ban pistol.
