Knowing what I know about Ken and his reputation, his relationship with Colt, and Colt's concerns about their parts that led them to stop selling the "spare" lowers, I'm about 95% confident that he wouldn't strip a factory lower from a complete rifle and part it out. I'm sure that Colt wouldn't be happy to see him do that. I'm sure that's also what the website includes the statement about the lower being registered as a rifle, because they got them from Colt as a stripped lowers but want to make it clear that it can't be built into a pistol. Most places (aside from AU) include a statement in their product descriptions for Colt lowers that say something like "these lowers were taken from complete rifles" or words to that effect.

My point was about the contradictory nature of ATF designations, that if it left the factory as a stripped lower, it clearly wasn't a rifle, but the technicality of registering it with the ATF as a rifle seems to magically make it so. It's like the discussion about AU transferring SBR lowers that don't have a short barreled upper attached to them, or the question about whether an AR lower receiver and semi-auto pistol frames meet the legal definition of a firearm. I'd be curious to know if the process of registering the lowers as a rifle requires them to state a barrel length on the form. I suspect not - it probably just lists a serial number and says "rifle." Just sounds like it could make an interesting court case for someone that has money to blow.
