I live in Louisiana and after work a few of us got together, had a few brews, and told jokes about our lovely state government. Many thanks to Kathleen Blanco and Ray Nagin for the laughs this evening!

Oh yeah, back to the point. No FFL is cool for grabbing a Mosin Nagant. I just wish that I were in the market for one.

As for our gun loving brothers and sisters who live in states with self-imposed, liberal minded, anti-gun legislation, I really feel for them. I find it funny how these same liberals fight for freedom of speech, while at the same time fighting to ban the word "God" from the The Pledge of Allegiance. Liberal hypocrisy is one of those things about politics that amuses and pisses me off at the same time.

<------ Look where I'm from, trust me I know its sad :(. It is actually really embarrassing to watch the news and see all of the misinformed politicians talking about the subject and putting new laws/proposals into effect. People here just eat up all the BS they are fed. The Great Western Gun show was basically banned here in Calif. because of Attorney General Bill Lockyer's bogus charges against gun shows/dealers. He had an entire scandal going about how he found all sorts of flame throwers, rocket launchers and such. It just turned out to be old memorabilia that was basically a tube with a trigger (no way in HELL it could ever possibly work) that just looks cool. The rocket launcher he found was also stated as being just a prop (which it was) no internals or anything, just looked good for him on TV. They didn't even find any of the other stuff he was ranting about and was found to be a scandal. Although none of that other unimportant stuff (the actual truth) was ever in the news and he was made out as a hero fighting for our(CA) safety. Were still fighting it today in court. The NRA has been a HUGE supporter for us Californians.

Also Senator Diane Feinstein has been noted in many many press releasing giving speeches on how if she could she would rid all of CA of its firearms in its entirety. Meanwhile she is carring a CCW permit and a handgun. When asked about it she says only her and elitist antigun cohorts should be allowed to carry guns. Yet the news (all liberals) don't pay ANY attention to her hypocrite words and go on with her story's everytime she brings up the subject. ARGGGGGGGGGG, sorry had to rant.

Well, the last time I was visiting family in Chautauqua County, even the deputies didn't give a crap what was being shot at the Ripley Rod & Gun Club (which is on land donated by my family).

She said as much years ago in an interview on "60 Minutes". Nothing new for those who've witnessed her (repetitive, cliched) act over the many years she's been sucking the tax-payers' blood like a parasite. Problem is, she keeps getting put back in because the hordes in CA are true believers. The only politically sane place I know of in Kali is the Central Valley (where I was raised), which is "fairly" conservative & an anomoly w/ in the state (Madera County actually issues CCW permits). I keep waiting for the frog to jump, but it just sits there, cooking itself to death in CA.

Yup. Same old Sweinstein. Right is wrong. Wrong is right. Been there, seen that. Bailed & sailed. The radical (& she is a radical, make no mistake) mindset in Kali is unapologetically hypocritical.

Yet the news (all liberals) don't pay ANY attention to her hypocrite words and go on with her story's everytime she brings up the subject.

Because, despite being (false) apologists for "equality", they actually subscribe to class hierarchy & the superiority of gov't over the people (Yesterday's radicals are todays reporters), much as the old red communists spoke of equality, only to hold the reins of power steadfastly upon seizing them. You're seeing a milder form of the same thing right now in CA.

Similar events might also happen up here in WA unless the old-school locals smack them back, as I've found that liberals can't stand the stink that they make, yet persist in dropping a(nother) load of the same sh!t at every place they invade & call home. I feel more like an old local than a CA-transplant, as I can not stand the agenda being pushed on the state - the same agenda I saw being pushed in CA 12 years ago.

You have my sympathies.

If you are .mil, CA will "let you" register your guns while you are there.
Sucks having to bow to the man, but at least you can bring them with you.

The gun laws in some places are rediculous. Do the lawmakers realize that they are just taking the guns away from the law abiding citizens? If a lowlife thug wants to get a gun he can get an illegal gun if he looks hard enough. And those self defense laws are rediculous as well. If someone dies because they bled to death from a non mortal wound then you can still be charged with murder. I live in PA so it's not that bad here, I just hope the NY and NJ bug doesn't spread here. In the mean time I'm going to stock up on 30rnd 5.56 mags and 32rnd 9mm mags just in case another ban comes along.

Just like we have an illegal immigration problem here in the U.S. wanting to bring their culture and language, we also have an internal "immigration" problem. Libs moving to the sticks or other states and expecting (no, DEMANDING) that their fucked up views now be the order of the day in their new areas of residence. Hopefully someone, or MANY someones, will have had enough one day and tell them to go back from whence they came. "Don't like how it is here? Then get the fuck out!" They don't grasp the concept that most people don't live in their liberal shitholes because they don't want to. Yet time after time those bastards arrogantly think they can call the shots from wherever they damn well please. It kills me to hear Schumer or Fineswine talking smack about guns. NEWSFLASH----we don't reside (or want to) in CA or NY, so keep your high-falutin' ideas to yourself and your serfs.

I hate to say it but are you sure you live in CA? those definitely aren't the laws here. I suppose you have some justification to say that or have you been listening to the gunstorre Special Forces Lawyers again.

psst look here at your leisure www.leginfo.ca.gov/calaw.html as long as you are going to live here, you might as well live smart. We have enough boneheads from out of state belittling and mis-stating our laws, guys that live here ought to at least know them and not give the idiots out of state more ammo to bitch on.

Here's a little bit of what you should be reading

197. Homicide is also justifiable when committed by any person in
any of the following cases:
1. When resisting any attempt to murder any person, or to commit a
felony, or to do some great bodily injury upon any person; or,
2. When committed in defense of habitation, property, or person,
against one who manifestly intends or endeavors, by violence or
surprise, to commit a felony, or against one who manifestly intends
and endeavors, in a violent, riotous or tumultuous manner, to enter
the habitation of another for the purpose of offering violence to any
person therein;
or,
3. When committed in the lawful defense of such person, or of a
wife or husband, parent, child, master, mistress, or servant of such
person, when there is reasonable ground to apprehend a design to
commit a felony or to do some great bodily injury, and imminent
danger of such design being accomplished; but such person, or the
person in whose behalf the defense was made, if he was the assailant
or engaged in mutual combat, must really and in good faith have
endeavored to decline any further struggle before the homicide was
committed; or,
4. When necessarily committed in attempting, by lawful ways and
means, to apprehend any person for any felony committed, or in
lawfully suppressing any riot, or in lawfully keeping and preserving
the peace.

198. A bare fear of the commission of any of the offenses mentioned
in subdivisions 2 and 3 of Section 197, to prevent which homicide
may be lawfully committed, is not sufficient to justify it. But the
circumstances must be sufficient to excite the fears of a reasonable
person, and the party killing must have acted under the influence of
such fears alone.

198.5. Any person using force intended or likely to cause death or
great bodily injury within his or her residence shall be presumed to
have held a reasonable fear of imminent peril of death or great
bodily injury to self, family, or a member of the household
when that
force is used against another person, not a member of the family or
household, who unlawfully and forcibly enters or has unlawfully and
forcibly entered the residence and the person using the force knew or
had reason to believe that an unlawful and forcible entry occurred.

As used in this section, great bodily injury means a significant
or substantial physical injury.

199. The homicide appearing to be justifiable or excusable, the
person indicted must, upon his trial, be fully acquitted and
discharged.

an unlawful and forcible entry = coming through a closed and locked door or window, etc

Can we say the Second Amendment is a restriction on the Federal Government and if there is no 2nd Amendment equivalent in the State Consitution we are SOL? ADM is a farm company.

I'm sure there are others here that can explaing the concept that the Constitution and the BoR are the governing documents for the Federal Government. State Constitutions say what the States can and can't do. (Or are you one of those sad souls that believes that for 230 years and longer the practice of regulating arms has not been a state and colony issue and that the all the federal. <snip>

My question is with the underlined portion. Since this doesn't appear to be defined within the statute (like "great bodily injury" is), has it (the definition) been settled/established in case law?

I'm wondering if they mean only "immediate family" (I would assume they would, but then again I have that luxury as a nonresident of CA). My point being that it would most definitely suck to have your abode broken into by your tweaker nephew or 3rd cousin, have to shoot his worthless ass, and then be prosecuted or drained civilly by his equally worthless parents and/or spouse.
Link Posted: 2/2/2006 9:52:06 PM EDT
I don't know if it has been specifically defined, but assuming they are not a member of the household, the intent is to mean a person actually living there.

The Laws are referred to as the Richardson Laws because they were about the only laws Richardson was ever able to get through. He was from Arcadia, and so annoyed the Dems over taxes, guns, spending that they hated his guts no end and having him on a bill was a killer and this was 30 years ago or so. I'm pretty sure it is defined because it was meant to clarify and standardize the prosecution of in-home shootings to NO prosecution. Some DA's used a duty to retreat and make the shooter prove fear of imminent danger, etc. Some were "if they step in they're dead and good riddance" standard.
Link Posted: 2/3/2006 5:53:38 AM EDT
Thanks for the clarification. Oh, and I prefer the latter standard.

On the other hand she can make a hell of a lot more money. This decision's going to suck.

If you are .mil, CA will "let you" register your guns while you are there.
Sucks having to bow to the man, but at least you can bring them with you.

-MARYLAND CUSTOMERS: No modern handgun sales to anyone including 01 FFL Dealers

Yes, folks you read that right.
MD FFLs cannot buy modern handguns unless they come equipped with an internal locking device.
Any wonder why I am moving out of this shithole after graduation?

Actually, this is a case where the company has it all wrong. First off, the internal locking device requirement is now satisfied with a through the barrel lock making all handguns OK. Been that way for over a year. And used handguns don't need a fired casing, so everything AIM sells would be fine. Next, they state they can only ship C&R handguns to 01 FFL holders, this is wrong, and everyone else ships them to MD C&R FFL holders. The hi-caps are 50/50, some stores sell them to MD residents claiming you own them when you pay, prior to them arriving in MD which is the truth, while others don't risk it. But, it is completely legal to own hi-caps in MD. Just can't transfer them.

In MD, other than the waiting period on handguns and assault rifles, you can get around everything else. Registered collectors, free, means no more 1 gun a month rule. The "assault pistol" ban is the most difficult as you have to register it as an SBR or AOW in order to get around that. I liked when they were going to pass an MD assault weapons ban, it'd have been illegal to buy an AR-15, but perfectly legal to buy an M-16 in MD. Our lawmakers must be smoking crack, its the only explanation. Oh, and my biggest beef, the only truly impossible firearm thing in MD is getting a CCW permit.

But this example is just a case of a store being more restrictive than legally required. I think it was MidwayUSA that wouldn't sell magazines of any kind to MD residents who live close to DC? Sometimes the stores themselves are goofy.

Correction re: Aim's statement about CT

Only the WASR is banned. and then ONLY if it's a 7.62x39

Nothing banning CETMES or other HK resemblence clones or FAL clones

You can walk into any CT gunstore and buy JLDs, DSAs etc.

AIM is often very WRONG about it's state listing requirements and restrictions

A couple of years ago the AIM catalog even had NO BUSHMASTER SALES TO CT...... which is totally wrong.

Double check your state laws before believing what some clerk typed into a catalog
