while i'm not happy that the death sentence was overturned, at least the stupid judge didn't overturn the CONVICTION. i think it would have been much harder to re-try the bastard and get another conviction than it will be to re-sentence him and get another death penalty. on a more disturbing note:

Just read a lot of the stuff on this case..... This guy is found standing over the officer, wearing a shoulder holster, with his .38 at his side, and 4 rounds fired and the officer was killed by a .38 and people say he didn't do it..?

Faulkner was trying to arrest Mumia's brother on a minor (misdemeanor) warrant when he was attacked. The brother has also been unavailable........ Lot's of BS little errors in this case. The ME said the wounds looked like a .44. So he can tell what caliber bullet made a wound by looking at the wound. So fo course Mumia didn't do it he had a .38. Witness accounts, by police, were attacked saying that officers took too long to complete reports, one was a hospital security officer that immediately completed a report. But a copy of the report was not turned over to Philly police for a few days....... Witnesses for Mumia appeared and made outrageous claims of what they saw, even though by there own accounts the were hundreds of feet from the scene of the shooting. Paris makes him an honorary citizen, celebties have fundraisers for him and distort the facts brought out a trial. And you wonder why sometimes we take the bashing personal or get crotchety when someone posts that police lie. Any officer could have been Faulkner, ambushed for doing his job.

I was in Philadelphia in late April or early May of '99, and had the misfortune to be a witness to a"FREE MUMIA"rally in downtown Philly. The crowd was full of suburban white kids trying to look poor, your usual assortment of activists dressed in either African tribal wear or Nation of Islam bowties, and a large contingent of urban youth dressed up in ninja suits with balclavas. The predominant theme visible on the signs these jerk offs were carrying was something to the effect that ALL cops should be executed,maimed,tortured etc.......... There were several of the organizers handing out literature from the communist party, detailing how it would save us all, and such a thing could never happen in a socialist society. Gee, I sure got a favorable opinion of the guy from these pieces of refuse campaigning on his behalf. Myself, and the three fellows that were with me immediately went to the nearest contingent of the Philly PD that we could find, and shook every one of their hands, expressing our belief that they had the shittiest job in the world but they still performed admirably given the conditions. I think that those cops enjoyed hearing that, I hope that they did, as that was our intention! I support the Philadelphia PD!!!!!!!!!!!!! Chuck

I wish the Federal Judge had been appointed by Carter or Hillary but he was appointed by Bush the First. After 20 (?) years he figured out the jury was not properly instructed (charged). The Judge should be charged.

I read the "opinion" of the good judge. To cut through the garbage I will present the meat of the 274 page opinion in plain english as best as I can. 1. This appeal is out of left field, but that's okay since cause both the dirtballs and the state sometimes used to wait in death cases. 2. There is no doubt he is guilty (the judge seemed impressed by the dirtball yelling he hoped the cop was dead wilst in the ER in front of non-police witness). 3. Dirtball had a buttload of BS claims on appeal. One claim was that the jury form was not fair. 4. On one page of jury verdict form it said that the jurors should report a factor that made them think he needed death more than normal (and stated that all jurors had to agree on each such factor to count it against Dirtball). 5. On another page of the form the jurors could list factors they thought would make Dirtball less deserving of death, there was no statement that all jurors had to agree on those factors to vote for life on said page.

Since jurors could be morons, and one other pro dirtball anti death case had assumed they were, the jury is treated as confused about whether they COULD have applied a factor in Dirtball's favor in their own mind when voting. 7. Therefore, the jury's death decision is treated as wrong, and the state can A. Appeal B. Race around, basically retry the case in front of a new jury for the penalty phase within the next sixth months, cold and on a cold case (fat freaking chance, even more so given Dirtball's "fame" with the liberal set) C. Obey the good judge's (federal freaking judge) ORDER to a state court to resentence to life (odd......I didn't know the federal judges had seized all power over state criminal processes...I thought state's maintained police powers in the constitutions and such forth)

Yeah, from what I've heard the guy is in solitary most of the time... and when he's not, he's in the library. He's become somewhat of a jailhouse lawyer, and we've all heard about his literary suck-cess. So not much chance of anything "bad" happening to him. On the other hand, if he were to have a hair on his head plucked, I'm sure it would somehow be slanted to seem like the Corrections Staff either had somthing to do with it, or were not doing thier job protecting him. Let him sit there and stew. Overall, as a LEO, this whole case is just plain sad. I've been disappointed since the beginning that liberal media, corporations, and Hollywood has been sucked into what would appear to be a fairly clear cut homocide. A cowardly ambush at that. It's disappointing that society in general has sunk to a level where the distrust for police is so high that they will not even seek justice when one falls in the line of duty. It seemed to hit bottom with Rodney King, but it kept going down from there. Just look at all the bashing we suffer at times on this very board. If it's not some fouled investigation, it's some screwed up tactics. As several have stated before, when the police do thier job, it's not newsworthy. When they screw up, it is. That's a shame. Even the WTC trajedy of 09/11... LE got pushed into the background. Maybe it was just me but the media made tons of referances to the 300+ Firefighters and "public safety workers" killed. At best Officers were lumped in as public safety workeds when more than 1/3 of those workers were COPS! Cops that came to work that day ready to do what cops do everywhere, everyday in this country: Seek out the problem and do their best to help. It's too bad the media and the nation won't give Danny Faulkner some justice. MSH441

Yes they certainly did and in the initial days of the forum, I'm sure support for Mumia was high. But once people who were in full possession of the facts started on the supporters, there really was only one obvious conclusion to make and a lot of former 'supporters' saw the light, to their credit. RATM's support for Mumia is VERY clear, though, especially Tom Morello. Notwithstanding the obvious guilt of Mumia in this case, It's always puzzled me why his supporters don't apologise to Danny's widow. See, a few months ago, a 'hitman' named Arnold Beverly 'confessed' killing Danny, which totally negated the stance of supporters that Danny had fired first and attempted to kill Mumia in cold blood. So in other words, Mumia supporters finally believed what we'd all known forever; that Danny was just doing his job and was in the wrong place at the wrong time. It's been revealed that Danny's record was exemplary AND that the REASON he was hit was because he was about to blow the whistle on the corrupt Philadelphia police department, which pro-Mumia people have always derided. Yet I never ONCE heard an appology from the pro-Mumia side for the decades of constant baiting and vilification of Danny's wife Maureen in accusing her husband of being "just another corrupt cop". Quite the contrary. He was trying to STOP the corruption and the vilification of black people and got dead for it. Fucking arseholes. Bear in mind, though that there are two untrue parts of what I just said; all the rest is true: 1) Mumia didn't shoot Danny. 2) There was a hitman. Anything to the contrary just makes no logical sense.
