If he's a suspect he doesn't have to say a thing to a Grand Jury. If he's NOT a suspect, then he HAS to testify in front of the Grand Jury. BTW, his lawyer can't be present either. |

Here's how it works.
He will have to appear. He will be told if he is a suspect. He will be told that he doesn't have to say a thing (and he won't, nor would most people)and he will be excused. If he's NOT a suspect he HAS to testify, the 5th does NOT apply in that case. Soooo, since he hasn't been arrested, the Grand Jury isn't there to indict him, so he'll have to testify. |

I don't think the prosecutor sees him as a suspect, yet he may be able to fill in a lot of gaps for them. ( that's just my read on it, I've been wrong before ;) If he was seen as a suspect, he would be sworn in by the Grand Jury Prosecutor, Mirandized on the spot and that would be end of it, he would chose to not answer any questions. It's a waste of time to bring a suspect in to the Grand Jury and ask him to incriminate himself. Although it is sometimes done just to f%ck with their heads, so to speak. |
