WASHINGTON — President Bush signed an executive order on Tuesday that allows military tribunals to try any [b]foreigners[/b] captured by U.S. forces[red][b] in Afghanistan or linked to the Sept. 11 attacks on the World Trade Center and Pentagon[/b][/red]. Bush's order, the first such action by a U.S. president since World War II, gives Defense Secretary Donald Rumsfeld the power to establish tribunals that could try foreign terrorism suspects here or abroad in secret, without many of the constitutional protections given to defendants in the federal court system.

From the linked article:
"After President Lincoln was slain in 1865, a panel of generals and colonels tried eight civilians charged with aiding the president's killer, John Wilkes Booth. All eight were convicted, and four were hanged." There is a precedent for trying Americans in such tribunals. |

Foreign COMBATANTS should be dealt with as such. If they are citizens that is a different matter.

Yeah, well if anyone bothered to do a little further research they would learn that the Supreme Court (that venerable institution that we are all so fond of for ruling correctly in the presidential election of 2000 and rely upon to keep the other branches honest) has ruled in the past that such courts for foreigners are legal. That is the precedent. I believe that ruling came in response to saboteurs during WWII from Germany.
It never fails to amaze me that folks here will say because something could happen it likely will. What is it like to live in that state of perpetual paranoia. A certain degree of paranoia is healthy, but those looking for a conspiracy in every pot need to get a life. What this executive order says is that terrorists are not committing domestic crimes, they are committing acts of war. As such they are subject to military law, not civilian law. Since they are not regular troops in a standing army they are not afforded the protections of the Geneva Convention. And guess what folks, the Supreme Court has said this is legal. I'm pretty DAMN sure that the Supreme Court would limit the scope of this power to what has been done in the past, foreigners that have committed acts of war. |
