Robbery victim shoots suspect
Attempt is foiled after a scuffle and gunfire in a parking lot

Sanders and Solorzano are charged with attempted robbery in Wednesday's incident. Both are in the Wake County jail.

An armed robbery in the parking lot of a North Raleigh apartment complex was foiled, police say, when the victim and a suspect exchanged gunfire Wednesday night.

Shortly before 8 p.m., police responded to a call about gunshots at the Riverwoods Apartment complex, according to investigators. When officers arrived at the scene, they saw Damian Powell, 28, who said he was the victim of a robbery attempt.

About the same time, a man wounded by a bullet walked into Duke Health Raleigh Hospital, and officials called police, according to Jim Sughrue, police spokesman.

The shooting victim was identified as Cesar Solorzano, 18, of 713 Merrywood Drive in Raleigh, according to police. Officers later charged Solorzano and Antoine T. Sanders, 18, of 3101 Burntwood Circle in Raleigh with attempted robbery with a dangerous weapon.

Raleigh police said Powell will not face charges in connection with the incident and that evidence supports Powell's account of events.

Powell recounted what unfolded Wednesday night as follows:

Shortly before 8 p.m., Powell parked his SUV in the parking lot and stepped out of the vehicle. Two men strode toward him through the darkness and rain. One man pointed a silver gun at Powell's head and told him to "give it up," Powell said.

The robber made further demands; then Powell grabbed his attacker's arm, and the two wrestled in the wet parking lot. Powell broke away from his attacker and ran to his car, where he had stored his handgun.

By then, the two men had moved away from the SUV. Powell said one of the men pointed a "big and cold silver" gun and started firing at him.

"And I fired back," Powell said. "It's the first time I've ever had to use my gun to defend myself," he added. When the shooting ended, the suspects ran.

Powell said he carries a gun because he's "kind of a celebrity." He declined to elaborate.

Solorzano and Sanders both have arrest records. Police arrested Solorzano in September after investigators say he shot a 16-year-old. He pleaded guilty Nov. 9 to a reduced charge of assault with a deadly weapon, according to court records.

After appearing in court Thursday with his arm in a sling, Solorzano was detained at the Wake County jail in lieu of a $250,000 secured bond. Sanders was also at the county jail with bail set at $75,000.

Theory on why Powell is a celebrity: He's really the Burger King King and doesn't want anyone to discover his secret, mild mannered, identity as Damian Powell.

damn, that takes cajones the size of bowling balls to grab the arm of a guy who has a gun pointed at your head.

lesson learned: keep the gun on you, don't leave it in the car.
