Background. Christmas Eve, there was a shooting at a local teen hangout.
Police investigating the shooting saw these two kids, and tried to question them.

A teenager is found with a gun but instead of going to juvenile detention, he goes home.
Around 6am Monday morning, police tried to stop a young man and woman, walking along
Kimberly Road in Davenport. (Kimberly is a main 4-lane road running through town)

Officers say the teens wouldn’t stop so they used a taser gun on the young man who they
say was carrying a gun. Police arrested him but they say they couldn't lock him up for two reasons.
Sgt. Eric Court of the Davenport Police Department explains, “The mere possession is illegal.
It isn't a forcible felony unless he attempted to use it. The mere possession of a weapon isn't
enough to get you placed in juvenile detention. Unfortunately with the number of beds in the juvenile
detention center within a 2 and half county in the 7th judicial district you have to weigh the offense
and what he did.”

Both teens were charged with interfering with official acts. The young man was also cited for
possession of a dangerous weapon.



Area citizens interviewed by the TV station were more than pissed.
So much for keeping the "bad guys" off the streets.

The officer they interviewed on TV last night went to far as to say that even if the kid
had pointed the gun at an officer, they probably wouldn't have locked him up.
(I figure that meant they would have just shot him dead and been done with it)

Thats incredible. Figures it would be back east. A minor can posses a weapon here, including a handgun so long as he is not commiting a crime or carrying it concealed.

This is Davenport, Iowa.
Not out east.

We are not allowed to carry a weapon.
