I have an employee of middle eastern ethnicity threatening to file suit because (he is a 90 day probate employee btw) he is forced to have the day off on a holiday that is offensive to him and can't get paid for it because he is a 90 day employee...

He even threatened me the he would retain a lawyer if I didn't pay him holiday pay AND apologize for Christmas offending him.
Link Posted: 12/26/2005 6:26:51 AM EDT
Tell him to go for it. If it is company policy that probationary employees do not get holiday pay, then it was condition of his employment. Sorry about his luck.
Link Posted: 12/26/2005 6:27:06 AM EDT
A long as that day is a scheduled shutdown day I wouldn't
think that would be a problem. When I worked in a facotry,
that was our scheduled maintainance shut down time.

I'd encourage him to waste his money on a lawyer.
Link Posted: 12/26/2005 6:28:10 AM EDT
Fire him.
Link Posted: 12/26/2005 6:28:57 AM EDT
Find a reason to can this guy, this is a sign of things to come...
Link Posted: 12/26/2005 6:30:19 AM EDT
I couldn't believe this guy, I told him to shove it, and if he wanted to retain a lawyer for 4 hours of non worked pay (he's part time), go for it, the big boss has billions to spend on attorneys, I'm sure it'd be taking candy from a baby.
Link Posted: 12/26/2005 6:32:18 AM EDT
Drop back ten and punt...
Link Posted: 12/26/2005 6:33:07 AM EDT
Is Florida an at-will state?
Link Posted: 12/26/2005 6:33:53 AM EDT
He's in the wrong fricking country. Remind him this is the USA, not the middle east. He can go back to where he came from if he's so offended.
Link Posted: 12/26/2005 6:33:56 AM EDT
Yes, at will
Link Posted: 12/26/2005 6:35:28 AM EDT
Express your deepest sympathy for his hurt feelings and offer hin some pork rinds as a gesture of reconsciliaton.
Link Posted: 12/26/2005 6:37:40 AM EDT
Tell him it’s a Federal Holiday, I’m not a Christian and a day off never offends me. As for apologizing tell him to apologize to you for September 11. When he say’s he had nothing to do with that tell him tell him you have nothing to do with Christmas being a company holiday.

LOL

I would also let him know that his services will no longer be required prior to his probation period ending.

Smack!!!!!

I wish I had that pic of that ME guy getting smacked across the face. Kind of appropriate for this post.

Your company certainly has an isurance policy just for this kinda thing. Shit can him.
Link Posted: 12/26/2005 6:52:42 AM EDT
On day 89, give him the ol' heave ho and tell him "Merry Christmas!"
Link Posted: 12/26/2005 7:13:36 AM EDT
I like that idea... he'll get his though...

Habeebs Supervisor: "Can you tell me if he is a probate employee?"
Me: "Yes"
HS: "Ok, he was 15 min late today and asked me to apologize for the traffic being backed up"
Link Posted: 12/26/2005 7:16:25 AM EDT
Being an ex-HR guy myself, I will tell you something we learned.

"While they are on probation, they are better than they will ever be."

This is a sign of things to come. Fire him immediately.

PEOPLE are generally stupid!....................along with the majority of HR people I've met!

Get rid of the asshole!

No kidding...hint of things to come.

Hopefully he doesn't know the alphabet; as in ACLU.

EDIT:

Keep us posted on this, will ya?

It'll feel good to see him tuck tail and run, or get hammered in court.

Will not be a problem, if it's an "at will" state.

Probation means "we're looking at you and may fire you for any reason".

They just got a reason.

I disagree. He is in the RIGHT country if he plans to sue everyone for every little grievance and get rich by doing so. In the middle-east, he'd be shot in the head for even considering such an obsurdity.

+1

Just tell him things are not working out...
Link Posted: 12/26/2005 7:43:45 AM EDT
Shit. Can.
As already stated, a bad sign of things to come. Get rid of him, yesterday if possible.
Link Posted: 12/26/2005 7:53:58 AM EDT
Well, I gave him the boot for insubordination

He barged in my office again, saying he called his relatives and they all said it wasn't fair that he wasn't getting holiday pay

He called me a "racist fuck" for not honoring his holidays as well

him: "You'll be hearing from my lawyer"
me: ::sips coffee:: watch your step out the door, you are no longer covered by workers comp insurance

I really want to kick the manager who hired him and wasted a $32 drug test in the nuts right now.

You've got a point there...

You have more patience than I. I think you represented your employer well - especially not giving that guy more ammo.

Once again, I understand why I don't work in an office environment.

I dunno cm, a company this size couldn't operate without an hr department to handle payroll, benefits such as 401k administration, insurance, associate relations etc. It's not all just whacking people who don't follow policy.
Link Posted: 12/26/2005 8:39:42 AM EDT
I agree. The term "Human Resources" says it all. Humans are not a "resource".
Link Posted: 12/26/2005 8:40:19 AM EDT
Fire him.
Link Posted: 12/26/2005 8:45:41 AM EDT
Fire him and have security escort him out the door. I would think the threat of a lawsuit is cause.

It would not surprise me one bit if this entire situation, especially his termination, was manufactured. You were manipulated.

His lawyer will be a relative. They will settle out of court. If they do go to trial for a wrongful termination case, the liberal-minded idiots on the jury will find in his favor (no skin off their noses and your employer has deep pockets). Either way, he will get some money and not have to work for it.

Edited to say, "You did the right thing."

totally agree. If this is how he acts during a probationary period, I'd hate to see how he would act when not on it.

More words of wisdom from OP.
Get rid of this guy or he will be a nightmare for you and everyone else to deal with.

ETA:I see you did. Good job.

I agree that HR attracts the lowest intellect in corporate management. No offense to OP. Not alol bad. FWIW, I haven't seen anyone, anywhere I have worked in the past 12 years who worked in HR that wasn't a woman or a queer. Figuring out where that has led us doesn't take a lot of contemplation.

Is he a citizen? Can ya get his dumb ass deported? Hell, I'm not Christian, don't observe Xmas, am forced to take 3 days off, no pay, while the plant is closed. I grumble about it a bit, and carry on. I'm not complaining to management or threatening to sue. Just the way it is, being an religious minority.

What he said. Bye Bye.

An explanation would be a generous and good thing; everybody can use some education. And don't say anything stupid.

Regards,

Rick
