Idiot cop, what difference does it make which way you park when the person doesn't pay attention to where they are driving.

It is probably against the law (it is in my city anyway) and just gives the insurance company a way to try to weasel out of it.

Im not saying she wouldnt have hit your car, she would have anyways by the sound of it. your car being parked the right or wrong way had nothing to do with your accident im sure, I was only pointing out that the car in the picture was actually parked illegal and is a citable offense. Nothing against you at all SPGrrl.

Sorry to hear your truck got hit.  It looks like it is repairable though, and the damage doesn't look like it's to the point where it won't be back to it's previous condition.  Nice truck BTW.

I dunno why cops are so anal about parking, but they are.  I used to live in a cul de sac.  One day I had to jump start my Ford escort and I pulled my truck up to the front.  The cars were parked around the circle counterclockwise, I pulled in clockwise and parked in front of the Escort.  After jump starting it, I put the cables away in the garage.  I didn't even get a chance to move the truck and the fuzz was there putting a ticket on my windshield.  The worst part was, our street was hardly ever even patrolled.  I think it was the cop who lived in the next building down doing his part to "clean up his neighborhood".

Get a lawyer.  Find out if she is a drunk. Get all the names of the witnesses, and get your insurance on it immediatly. If they turn out to be uninsured file under your uninsured motorist coverage as a phantom vehicle strike.  Friggin cop should have been all over her not you! What if that had been a 10speed and a child? probably drunk, or just terminal stupid.

Well SP1Grrl, if it makes you feel any better. Picture this.

Back when i was maybe 12-13 my friend and i we're out riding our bikes. He's hauling it down a hill and not paying attention, looks forward in time to realize he veered into the parking lane. Lets just say that the parked car came up quicker then he could react. lol. He wasn't hurt... but damn that was funny.

Sorry bout your car - glad you weren't in it.

For future reference, the proper parking hierarchy is to park the most valuable vehicles in the garage, the medium stuff goes in the driveway, and the beaters go out on the street.

Anyway, sucks to have some idiot smash up your car. I don't see too much of a problem with getting her insurance to pick up the tab, though; sure they'll bitch about and try to stonewall you, but that's what insurance companies do.

That's what we said.  The cop told us that there are reflectors on the back (not the front) which let other drivers know there's a vehicle there.

You mean the big black SUV parked there didn't give it away?!?!!?

actually yes you are in the wrong parking faced towards traffic is a no-no everywhere in this country and the 'big black SUV' thing is very ignorant and yes it's my fault for saying/pointing it out I imagine running red lights and killing others is acceptable too, carry on

No flame intended SP1Grrl, and I'm not trying to add insult to injury. Sorry about your vehicle and you're right, I would have cited the driver for Inattentive Driving at the very least, but you should count yourself lucky that you didn't get ticketed.

Prepare for a battle with any insurance company(s) that might be involved. You're probably not going to get your vehicle repaired without a fight.

Clean it up real nice in & out except for the paint transfers and damaged areas.  Then get the dealer's body shop to come out and write an estimate on the body damage AND mechanical damage to suspension, engine, steering pump, running gear, radiator (look for little seeps coming out at the tank edges), motor mounts, tranny, transfer case(?)  USING OEM PARTS.  All suspension & other parts on the passenger side out (and more) including the wheel & tire, hub, everything, should be replaced too.   Get hubby to crawl underneath and look for distortion, bending, stripped fasteners.  Check everything you can, windows & doors functioning & locking, seat adjustment, etc.  Don't confine your search to the area of obvious damage.  Make sure the adjuster notes EVERYTHING you notice and figures it in, again using OEM  parts and materials, including paint. A lot of stuff gets overlooked when the adjuster shows up.

Frankly it looks to me to be a possible total loss for the insurance, see the uneven gap between the 'bumper' and the trim between the lights?  Could be the bumper, could be a screwed up unibody.

Not to say it can't be repaired, but it will never be right.

Hope you had collision insurance.  Is that water on the concrete?

Isnt left of center a moving violation?? I dont think she was moving at the time.

Worse case scenario, she gets a parking ticket. And only in a kommie pinko police state, not in a free country.

If she is against the curb, in a neighborhood it makes little difference which direction she is actually headed. In fact a case can be made its much safer for her to exit the vehicle on the curb, instead of in traffic, especialy considering the driving, as demonstrated by this accident, that she routinely notices in front of her house. And we all know 80% of all accidents occur within 2 miles of the home. She sure hit the ball out of the park on this one. And she wasnt even home.

Hope Grandmas china is ok.

Glad you're okay SP1Grrl.

I would expect a battle with the insurance company though.

This lady would have hit your car had it been pointing the right direction so it shouldn't matter. But as said, the insurance company is in business to make money, not hand it out. They'll throw a fit about the "illegal parking."

Check grandma's china, pronto! If it's damaged in anyway be sure to report that too!

Good luck. Keep us posted.

to anyone that says the vehicle will never be right, is wrong...a well qualified tech can restore the vehicle to pre accident condition. As far as diminished value (DV) goes, check your state laws and a lawyer. It is sometimes hard to prove DV. DV usually is reserved for vehicles that had extensive damage.  By looking at the pics it doesn't look all that bad....the final bill will most likely be 30-50% higher than the initial estimate due to the hidden damages....ie apron, core support, etc... good luck

I have many years experience in the collision industry......a quality driven shop strives to have every vehicle repaired back to pre loss condition....as frame damage goes...you can actually pull a frame to tighter tolerances than when it left the factory...the amount of training and equipment that the top shops use is unbelievable...

BTW in most accidents the AIs are required to list any apparent violations and unfortunately this was one.  Or are you guys asking that LEO pick and choose what they notice?

Drunk totalled my truck last year by crashing into it while it was legally parked in front of my house.
Did the woman have insurance?  Will your insurance cover your vehicle if it was illegally parked.  I dont know what the law in your state is but in my state you must park withen 18" of the curb.  A vehicle facing the "wrong" direction is about 16' from the curb.

Why is the cop an idiot?  Sounds like you are an anti cop asshole.
Parking the wrong way had nothing to do with the cause of the accident which should be excessive speed or driving left of center or distracted driving, but it is still wrong to park on the wrong side of the street.

By the way SP1girl, your lawn looks fine!  I hope they have insurance and fix your car.

I doubt that very much.  The worst case for her is a parking ticket (probably $30) for illegal parking.
The other driver is definately at fault as she hit a parked vehicle.  No way around it it is her fault.  Even if SP1girl left her car parked in the middle of the street, if you hit a car from behind it is your fault.
Like I said, excessive speed, following too closely etc...............

Not asking him to pick and choose.  He did in fact put my parking violation in the report.  I'm sure the insurance company will have a field day, but the fact still remains that she hit my car, and would've hit it regardless of which direction it was facing.  She admitted to not paying attention.  How far can her insurance company go in denying any liability on her part when she owned up to it?

It's still a parked car that you weren't in. Doesn't matter how it was parked. According to law she is completely at fault. You can't be at fault when you were a non-patricipant.
