I'm glad someone else was reading the Constitution. I did so today, and I had Kerry in mind. If he was a reservist he is in very deep shit, and the UCMJ is only the beginning. I found two Constitutional violations:
First the easy one; Article 3, Section 3, Definition of Treason;
Section 3"Treason against the United States, shall consist only in levying war against them,
or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court."
Also an overlooked one; Amendment 14, Section 3, Denial of rights to hold public office;
Amendment 14"No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or
as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States,
shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability."
Looks like his time as an elected official is invalid and so is his place in the election.
