The "Factoring Criteria" document in determining whether you're a felon is 293 pages..... The Executive Summary of the Rule change runs 13 pages alone.

They definitely re-wrote this in preparation for the Supreme Court kicking their teeth in based on Bruen and WV v. EPA.

So now my question is are they going to require photos of the firearm for the free stamp? or is it going to be the wild west of everyone registering a dozen stripped lowers for free?

Was it published in the register today though?

For trust applicants, ATF will perform a thorough review of the trust
documents provided with the eForm 1 application to ensure the firearm sought to be registered
to the trust was property possessed by the trust prior to the date the final rule is published in
the Federal Register.
Therefore, an eForm 1 application to register a firearm equipped with a
“stabilizing brace” to a trust will be disapproved if the applicant fails to demonstrate the trust
possessed the firearmprior to the date the final rule is published Federal Register.

I have a 120 days to make my braced pistol legal, but I can't make it legal since my state made it illegal to sell parts earlier this week.

No doubt of that. In addition to practically causing the NFRTR to combust and the delay time for all form 1/3/4/5 transfers to skyrocket it's going to be weighing down multiple courts.

Looked at from that point of view it's pretty obvious what the intent is.

It says you have to render it inop or get rid of it. However, it says it doesn't apply to 16"+ "rifles". So, what if you only have 16" rifles? What if you have a mix of both pistols and rifles. Does the mere existence of a pistol upper and a brace in the same location constitute some sort of "constructive intent"?

This shit is retarded.

For these reasons, it is necessary for the Department to amend the regulatory definition of “rifle” to make clear to the public the objective design features and other factors that must be considered when determining whether a firearm equipped with an accessory, component, or other rearward attachment (e.g., a “stabilizing brace”) is a rifle designed, made, and intended to be fired from the shoulder.

Funny, I'm pretty sure they don't have the authority to create definitions for things that are already defined in statute.

It also looks as if I am going to buy a few braces this weekend, slap them on some lowers, and amnesty register them as SBR's so I can swap out the braces for real stocks once the stamp is approved. Once it's an SBR, you can freely swap around parts and it's still a registered SBR.

According to this even the old style AR pistols with only a buffer tube is now illegal.

(4) whether the surface area that allows the weapon to be fired from the shoulder
is created by a buffer tube, receiver extension, or any other accessory, component,

Just owning a brace is illegal without it on a stamped SBR.

or permanently remove and dispose of, or alter, the “stabilizing brace” such that it cannot be reattached;

Aaaand it’ll be at least three years before any court case gets up to the USSC.

Historically, there were zero restrictions on firearm length, weight, construction, barrel count or rate of fire at the time of the country’s founding. Fuck the gayTF.

They mention "objective" design features, but their criteria is inherently subjective.

Objective would be specifically outlined in statute, something they have no authority to create.

Am I wrong? @NoloContendere

It's a tax-free registration period. It's been done for individual items multiple times in the past, and has passed judicial scrutiny.

Indeed.

This has been - from the start - intended to fulfill the goal of removing effective short barreled rifle caliber arms from civilian hands. Other goals exist as well but the "scary" AR/AK/semi auto pistols in rifle calibers? Those have been a target for years.

Dropped the 4999 form, but say this in the document:
All of the objective design features and factors listed in the rule that indicate the weapon is designed, made, and intended to be fired from the shoulder are derived from the NPRM and proposed Worksheet 4999.
