Is it possible that this is a reasonable tactical measure? Instead of arresting the terrorist, have him followed from the point he enters the country so that the authorities get to find out his contacts, etc. Kinda like following a drug pusher around instead of busting him, in order to find who the major drug barons are and how their operation works, then busting all their asses.
