This bill is soon coming to Raleigh......... "NC Firearms Rights Act": BC Constitution on RKBA: 'A well regulated militia being necesary to the security of a free state, the right of the people to keep and bear arms shall not be infringed,and, as standing armies in the times of peace are dangerous to liberty, they shall not be maintained and the military shall be kept in strict subordination to and governed by the civil power. Nothing herein shall justify the practice of carrying concealed weapons or prevent the general assembly from enacting penal statues against that practice." Purpose: The purpose of this act is to officially recognize any able bodied man, woman or child who is capable of bearing arms as a member of the militia mentioned in the NC Constitution and to officially affirm that the right to keep and bear arms is a Constiutionally protected right that is guaranteed for legal and law abiding citizens of North Carolina. Section 1: Since a militia is necessary to the protection of the state and homeland, this act officially recognizes every able bodied man, woman or child who is capable of bearing arms as included in the definition in the word "militia". This act does not apply to those who are prohibited by the Fed Gov from owning firearms. This section of the act covers resident citizens of the state of NC. Section 2: This act officially recognizes thr right to keep and bear arms as an individual right and one that is Constitutionally protected. Further this act shall not construed to allow those convicted of a felony to possess/own firearms (unless expunged by law). This act officially recognizes the right of lawful law-abiding citizens of NC to possess any firearm in accordance with the firearms and weapons laws set forth in Chapter 14 Criminal Law in the general statutes of the state of NC. Firearm- Any gun or weapon that discharges a projectile by means of gunpowder. [b]-END-[/b] CRC
