It's really not necessary if you read the federal law (922) properly. A Semi-Auto Assault weapon (SAW) is a rifle that has the ability to accept a detachable magazine and [b]two[/b] or more of the following features.
1) Pistol Grip 2) Flash Suppressor 3) Bayonet Lug 4) Folding or Collapsing Stock 5) Grenade Launcher (37mm flare launchers don't count) So by definition a post ban firearms with a pre-ban mag is not a SAW. Just like a Glock made after 94 with a pre-94 hicap is legal. Same reason. The law deals with two separate things. 1) Cosmetic Rifle features 2) Magazine Capacities The two are exclusive of each other and no mention is made in the cosmetic feature rules regarding magazine capacity. And no mention is made in the ban of manufacturing hi-caps after 94 regarding what firearms you can put them in..... The letter linked below asks the ATF regarding use of hi-caps in imported post-ban rifles but the ATF response regards ALL rifles and hi-cap magazines regardless of manufacture/import date/country of manufacture. The proof positive is the legislative records, or laws.
Since there are no laws prohibiting said action.... you are free to do said action. I doubt you are going to find a well written "proof positive" in legal format that you can put a preban hicap in a postban rifle.... For the same reasons, you dont need "proof positive" to know that it is legal to breathe air..... or to wear blue jeans, or get a new set of tires on your car..... |

Thanks...just a discussion I am having with the local SWAT Sgt. who is 100% positive that it is illegal to place a preban mag into a postban firearm.

Well, he's 100% wrong. I know a SWAT officer here that carries a "MP-15 or something". Law enforcement do not always know the law (or guns). [(:|)] |

If that were the case, gun stores across America would be guilty. Bushmaster openly sells "granfathered" magazines. Your SWAT Sergant needs to get his facts straight, or is he planning to transfer to BATF?
