Since when are 16-19 yr olds driving cars considered a group of eight children? These were punks that were getting ready to vandalize a cemetary and got caught. That's a great story about ghosts, and were just on the way out and such and "children" and such. I guess times have really changed. I interrupted a christian church vandalism and robbery in progress by some punks several years back. One of the group fled on foot and I put a round in the dirt behind him. The others fled in a getaway car. I chased and ran the perp up a blind alley. Held them in the car with hands on wheel and dash, with barrel up their nose until cops arrived. Gave them the "dirty harry" speech to settle them down. Cops took them away, said they were on the way to pick up the perp on foot, and gave me my gun back within the hour, told me to be careful. Of course there was evidence of forced entry for them to see. That's some rocket science right there. It worked for me, TommyT. Oh, I was the one with the ski mask, gloves, and black hoodie also. Few days afterward, the pastor and congregation of the church gave me an attaboy. They never had anymore break-ins or vandalism for the next decade (probably because of the crazy man that guards the church at night). I guess that is what counts. |

You guys must've had some lame-ass teenage years. I am so fucking glad I grew up before kids spent all their time on the internet....we used to go out and do shit like this ALL the time.
And "no" we weren't vandalizing or breaking into anything, there are lots of old abandoned cemeteries and old buildings throughout the country that kids like to get into. At worst we may have been trespassing but back then there wasn't a truckload of dumbassed internet warriors just waiting to get back online and detail their 'drawdown' story on a bunch of teenagers. |

According to the information available as presented, Mr. Swallows called in a report of shots fired and informed police that he was holding several persons (suspects) at gunpoint. These persons were apparently eight teenage individuals. Despite that the only recognized number of persons held by Mr. Swallows was eight (8), there were a total of nine (9) counts of each charge. Based on the available information as presented, this is a serious WTF. It appears that a man heard gunshots, saw suspicious individuals about that same area as the reported gunfire, and therefore operated on the reasonable assumption that one or more of these persons is responsible for said shot(s). Police arrive on scene, discover him holding eight persons, and proceed to charge him with a number of counts inconsistent with the number of persons involved. W T F |

This report appears to have been written from a police report of an arrest. As such, it is simply dry facts of one side. I am waiting to see both sides. Let’s face some facts: You do not gather facts from a story, after dark, in a cemetery. You commit mischief and vandalism after dark in cemeteries. It takes no effort at all to reread stories of the scores of thousands of dollars of theft and vandalism committed upon families in cemeteries over the last several years. He yelled at them? He brandished a weapon? And how exactly to you contain a crowd who would otherwise flee a crime scene of 'their' making? Swallows deserves a medal. The judge who gets this needs to tell the families of these spoiled little brats that the parents will split the teacher's court and attorney fees. We all know what would happen if retired Judge Williams had this case down in Chattanooga. I pray Swallows gets a judge who is street smart and understands the pain of families whose graves have been desecrated. I am sick of children, gangs and the several factions of the "I know my rights” class running roughshod over civility and dignity. Children, grow up. Mr. Swallows, next time just block the gate and wait on the sheriff at the street. Then demand the sheriff pay the vandalism bill for being slow. When I was a teen, yeah back when Kennedy was President, 50 people in town would have stood in line to buy this teacher's lunch. Ok know that I know where you are talking about.....those people in that Area are some messed up special people..... I live on the other side of the mountain...so please dont confuse me as one of those! I saw the article on the local section of yahoo news, I shook my head and was hoping there was a better reason. |

I am sure he had a really good reason to hold them and then call 911, only for he himself to be arrested. I know the cops are crooked in that area. In all that area including Soddy, Soddy is the worst. I hope the guy gets freed, but as the schoolteacher in GA (ringgold or Ft O, their reputations will be tarnished for forever and wont be able to teach again. The guy was stupid for holding them there with an AR, that was his bad, you cant do that in TN at least....the only reason you can pull a gun is if you are going to use it. |

My friend's father was in a similar if more serious situation where actually had to use his AR-15 and killed and wounded "kids" (they were all in their 20s) trying to shoot at and run him over with their car on his property. He stated they had fired at him with what he thought was a .22. Two people had gun residue on their hands and .22 casings were found but no gun was ever found (those not hit ran off into the bushes; they could have ditched or hidden the weapon at any time, although the police did look around). Just because no gun was found does not mean there was not a gun involved. One wonders if the cops looked around. If not it would not be a stretch for a weapon to have been ditched and then recovered later. |

Would this be a different story if the guy brandishing the rifle was the owner of the property? Because to me it seems like there definitely must have been shots fired or some other sort of threats/intimidation going on because if this guy was the property owner holding a group of 9 people at gun point I really doubt he would have gone to jail. Which in my mind means this guy had just as much business being there as the kids did, which is none. 9 vs 1 are some pretty stupid odds to put your self against, even if you have a rifle, but it might justify his actions in my mind if the kids were up to no good, provided this guy is the caretaker or has permission to be on the property. |

That is going to depend on various state laws. In most states you can't pull a gun on someone for simple trespassing. From the article above, the judge does not seem to be happy the kids were not brought up on charges. I don't think this case is going to go very far. |

So how are you supossed to detain a group of possible vandels if you can't use a gun, or are you just supposed to let them go and let the police try to figure out who they were later?
