Updated on Page 2. I stopped at a 24 hour McDonald's to get something to eat while I typed up a paper after work tonight. I pulled through the drive through, started to pull to the end of the lane, close to the corner of the building, when I see the car in the parking space in front of me has their backup lights on. I stop just before I reach the corner of the building to allow them to back out of the space (she is almost directly in front of me). She begins to back up--STRAIGHT BACK. I beep at her, and she stops. She then continues to back up (she has to back up straight back about 30 feet PAST the end of her parking space to hit me--across enough space so 2 cars can drive comfortably past each other) so her right rear corner hits my driver side door, scrapes it, and scrapes back to my wheel well, causing body scrapes and smashing the plastic wheel well edge cover--the whole time I'm leaning on my horn to get her to stop, as I have nowhere to go. I have to roll down my window to have her pull forward--she seems to be so intoxicated, along with her two friends in the car that she cannot get it into forward. She finally pulls forward, back into the parking space, and I pull into the next available parking space--separated from her by one car. I open my door to see her pull back out of the parking space, tear out of the lot and drive off down the street. I did get her license plate. I call 911, report her vehicle description and license plate. I wait for the police to come for 15 minutes, call my 24 hour insurance ##. In the end, I call back to the police, tell them I'll report it the next day, and tell the insurance company that I'll file it with my agent the next day also. I got tired of waiting, and have to write this damn paper. Now I'm in a foul mood, trying to type this paper without being so pissed off. I just know I'm going to get screwed somehow in this--I don't have any witnesses--I doubt the people in the McD's would have seen out the window, and by the time I left the parking lot, the people who might have been around had already left also. Something tells me I'll get a ticket (failure to stick to your diet, maybe) or my insurance will stick me with whatever deductable or raise my rates.

Maybe they've got a video camera trained on that area. Ask the McD manager. Good luck on your paper.

Should be a hit and run. Her car should have matching scrapes when they catch her. I know, things aren't always that cut and dry. Good luck!

It sucks dont it?GT censored ((SOME)) LEO's dont give a rats ass about drunk drivers.I went through 6 months of theropy due to a drunk that damn near hit me head on at 55mph when he decided to make a left hand turn at the last second. To bad he drove right into my door.Dont remember much after that but i know he never stopped. Some folks who saw it called 911 took LEO's from 2 blocks away 15 minutes to show up.Small town with 20 cops lol.On top of that the drunks that hit me drove back by when they were trying to strap my ass down on a board. The whole front of the car was crushed. To make it short and sweet. They stopped the car.It had 4 illegals in it. they couldnt prove who was driving at the time of the wreck and they would not do a breathalizer test so they let them go.What a crock of shit.To this day i wouldnt help one of those leo's from that city if their life depended on it.
Link Posted: 3/21/2002 11:22:41 PM EDT
AZPLINKER,,,, Mayby it is your sunny personality that kept the cops away.... anything to start the LEO bashing huh?
Link Posted: 3/21/2002 11:37:44 PM EDT
GT its just the cops from that city.Trust me if you knew that wonderful city as well as i do you would agree. Most the county and state LEO's I know feel the very same way.For some reason T-Town cops have a real big chip on their shoulder. It doesnt matter how civil you treat them they dont honestly care.
Link Posted: 3/21/2002 11:51:47 PM EDT
That could be AZ, I don't know the city,, But I was a "local" cop for a few years, (moved on to greener pastures) and always heard the "If you guy's won't do anything for me then I'll go to the state police!!" Then they call the state police who are on a call on the other side of the county, and respond when their next shift starts. If you work for a small dept, you work for every single person in the jurisdiction, and they know it. It's all relative.

I tell ya, McD's is a death trap. If it ain't scalding coffee or fatty fries it's drunks in the parking lot. If I were you I call my lawyer and sue McD's. [;)]

Hey to every leo out there ,nobody who has any grey matter working knows that you are just like the USA GOV. You are there because we need you and we hire you to protect us! Our Gov is as laid out is of the people by the people, the leo's are the same enforceing the laws made by the people , you want change then you go to the poles and get them. this is a democracy right now its against the law to step out on the front porch and blow the speakers out of that basterd using his (against the law boom box amp ) but if you pass a law saying that its legal to use them for 45/70 500grn moving targets , well you get the picture! The police are working within a structure that we the voteing people give them, and when they step out of those guidlines then they are free-lancing- and then they are above, beyond,or outside of the law and are in judgespreduince of higher laws. Much like soldiers who go beyond those boundries.. The real Gov (of the people) and LEO'S (of the people) are your friends and are allies!.. bob cole

You should have called and sounded frantic. Then explained that you had just been smashed into by a drunk driver and were severly injured. Also that the driver that hit you had sped away and you thought that you saw her hit a pedestrian trying to cross the street. Also, you thought you had earlier observed her and her friend doing drugs in the McDonalds parking lot. That would have probably got the police there a little faster.

Damm dude, that really sucks, but what do you expect in the city of Chicago? Mount the State Arms on the hood next time! [sniper] People run all the time there, they think its better to run, than to head on down to 26th and Cal. Hope they get her, next time tell them she waived a pistol on your ass. Quit eating Mc'D's. Last time I saw you, you were starting to hang over the belt! [;)] c-rock

Same bullshit happened to me about 20 years ago. Drunken bitch hit my car in a parking lot and smashed in the passenger door. I called the cops, cops show up and won't do anything because the collision wasn't on the public street, it was in a private parking lot. Whether she was wasted didn't seem to matter to the cops, although with the change in DUI laws, today that might have been different. I go after the bitch for the damage to my car, she leaves the state, I get screwed. That's life . . . sometimes.

Do what I do-drive a shitty car for commuting. Sure, it doesn't stop dumbasses from rear ending me on a yearly basis, but my insurance is next to nothing, and I don't get heartburn everytime some gets near my vehicle. Add to that the benefit that most thieves walk past my truck and ignore it and it's contents. I look poorer than they are. Cars and trucks are a giant black hole for money,IMHO. "Woof"

Get a lawyer right away. You might have been hurt in the accident and not even know it. I once had some senile old f**ker plow into my car which was parked on the street in front of my house. Insurance company offered to pay 1/2 the value of the totalled car. I sued in small claims court and won but didn't get the full value for the car. You need to get a lawyer right away and go after her personally and her insurance company. Once she sobers up her story will be that you hit her, she was just a nice girl trying to drive home to her mommy and mean old you plaowed into her. Get your witnesses lined up and see a lawyer right away. GunLvr

I was hit by a lady 5 weeks ago. The day after the accident, which she was cited for, I got a rental car because my car (2000 trans am) has $13000 in damage to it and can't be driven. Over the past 5 weeks her insurance company totaled her car and cut her a check, refused to pay for my rental car because there are too many "issues" with my claim against her and they just approved the work to be done on my car last week. I hate dealing with insurance companies.

Ya. A few years ago, a drunk kid plowed into the back of my car which was parked on the side of the street. It is 1:30 am and hearing this loud crash I immediately go condition red and head outside to see an empty F150 where I had originally parked and my car 30 feet away in the middle of the street. I yelled to the neighbors to call 911 as this kid of about 18 reeking of alcohol comes staggering down the sidewalk saying he hit my car. Took the cops 45 minutes to show up and they didn't arrest the kid even after he admitted to drunk driving. The POS truck was leaking gas and the cop MADE ME help the kid push it back to the curb. Took 3 weeks and $3700 to fix my car. Oh and by the way, some bastard decided to shoot out the rear quarter panel window of the rental car I had. Cost me $150 to get that replaced. The cop responding to this incident said "oh it was probably a rock flung from the tire of a passing car". Ya right.

Update: I called my insurance, and finally got to the Police Station to file the report. No criminal charges against her, but I do have her name (the car is dual registered under Vivian and Jennifer--I wonder which one is the daughter??), and address. I figure she probably hasn't told mama yet, so when my insurance company calls to collect, she'll catch hell. I thought about chasing her, but figured that wouldn't make much sense--she took off fast (about 35 mph), so by the time I started my car, got out of the parking lot, she would be fairly far ahead. Not worth driving 50+ mph through the city to catch up to her over minor body damage. And, when I caught up, what would I do? Pull her and her friends out of the car and do what with them? Maybe I should have packaged them up in boxes and sent them to Imbroglio? I had her plate number, a description of the car--really didn't need more than that. If she had gotten out of the car, even intoxicated (which she undoubtedly was), I probably would have just exchanged insurance info and told her to take a taxi home and I wouldn't press charges (not that I really could have in a private parking lot).

Since when? If someone damages your car in a private parking lot, I'd definitely say it's still a crime. What's the difference between that and damaging someone's property in their driveway? That's called vandalism, as far as I know. A crime is a crime, regardless of whether it's committed on private or public property. I'd press charges, and go for the max - people HAVE to be made to take responsiblity for their actions, one way or another. PS - I normally detest "what if" scenarios, but "what if" she ended up killing someone on her way home? Would you then wish you'd have stopped her and/or gotten the law involved?
Link Posted: 3/23/2002 2:22:59 PM EDT
NH2112--you missed my point. 1. I did get the law involved when she took off--I called 911 and reported the accident, her car's description, the direction of travel, and the fact that she was undoubtedly drunk. 2. If she had gotten out of her car, I would have:
I probably would have just exchanged insurance info and told her to take a taxi home and I wouldn't press charges (not that I really could have in a private parking lot)

. I was going to obligate her to take a taxi home, and leave her car there or I would press charges. The comment about it being in a private parking lot was added because here in the City, they basically won't touch it--it becomes a civil matter unless it happens on city property.
Link Posted: 3/23/2002 6:07:57 PM EDT
Interesting, here if you are on private property, that is open to the public, DUI is enforcible. If you are on private property that is closed to the public, say your 150 acre farm, DUI is not enforcible. NH2112, a crash is a crash is a crash, unless you have evidence that it was an intentional act done purposely to damage someone else's property it is NOT vandalism, it is a crash.
Link Posted: 3/23/2002 11:15:27 PM EDT
NEXT time just call 911 and tell them you were hit by a drunk driver but not to worry u were able to shoot them all with your .50 cal fully auto handgun with 300 rd clip and silencer that you conceled illegally in your tank top,you won't be able to get out of your vehicle before the JBT's and medics arrive as the guy that sold you your car said TRUST ME

OK, got ya now. What really threw me off was the thing about it only being a civil matter if it happened on private property. I hope that's not how they look at ALL crimes that take place on private property! Although, it should make it a lot easier for you when you have to shoot a burglar outside your home and drag his ass back inside. [:D]

I understand that, I was just using vandalism on private property as an example. What good is the law if criminal charges can't or won't be pressed when a crime is committed on private property? Why should YOU have to foot the bill when someone breaks a law and causes injury of some kind to you? Isn't that the DA's job? If DUI and leaving the scene of an accident in a McDonalds parking lot is considered a civil matter because it happened on "private property" what other crimes would only be civil matters in the same place? Possession of child porn? Rape? Murder? Burglary? Having a gun without a valid FOID card? If not, why are they different?

I know where AFARR is, and its in the City. At a late night, the police only protect the Krispy Cream shots, or are back at the station torturing/beating suspects. They are too busy to go after hit and runs, cause you hear about them all the time om TV, and families ask the public to find out who did them. c-rock

I don't think you will be too screwed. It's kind of hard to drive your car sideways, so the dent in the door has to be the other persons fault and pretty easy to prove. You also have the 911 report, the other car will not. Surely if you had hit their vehicle they would have reported it. Get the police report, making sure it mentions the 911 call. Also, if any part of you starts to hurt after the accident, such as your neck, make sure to mention that. I think you have enough evidence to take the drunk girl to the cleaners.

The beginning of the end for my respect for LE happened as follows. Was swimming in a friends pool and had parked my car on the street in front of his house. Heard a loud crash and went to investigate. Found my car smashed (total) and the doer w/buddy staggering around his uninsured POS. Minority types. Theirs was disabled though they were trying to get it going. Called the cops who responded in a reasonable time. Cops wrote the report, indicated doers were drunk etc. REFUSED TO ARREST the drunks!! Said, quote "we don't have enough men on duty to arrest these guys". There were four of us standing there with our jaws down and told the idiot cop to get his cuffs out, WE would subdue the perps and turn them over to him. He got real agitated and threatened to arrest US! In the end, no arrests, my car totaled, perps had no insurance so I was out a car. Filed complaint on the LEO but no action taken, of course. I have had three cars totaled by uninsured pukes. Next one, I am going to jail! Driving without insurance should be a capital offense!

My wife was driving around an S-curve on gravel one day when some kid decided to park a Grand Prix in the side of our Lumina van. Drove the entire drivers side in making a huge gaping hole there. My wife calls the cops on her cell. Officer shows up and tickets my wife. Said she was left of center. Had to eat that one.

Since you got the plate number, hopefully they will track her down. Last week, I was coming back from my buddies place (he is near several bars) and there was a chick pulled over getting a sobriety test by the man. Two more blocks, and there is another chick (hot looking) getting the DUI test from the man. I get off the freeway heading towards home, and there is another really hot chick getting the DUI treatment from the man. Either cops like to pull over hot babes and make them submit, or chicks are really stupid and like to drive drunk.
