i thought they could only sell right before New Years & 4th July?

can sales be any time of year? Live near Bastrop St Park & not a real big fan of
letting Jethro try & burn my house down (missed twice so far) for some jollies.

some one is selling in Bastrop County & sheriff looking into it.

eta; should a looked first; apparently the state allows county commish. to approve it during other periods;
San Jacinto Day & prior to Memorial day, but i still think it's bogus; yes our county comish. approved it
(or at least it was on their agenda, so I suppose it got approved)

The Texas Legislature passed HB 1150 in 2015, which allows for the sale of fireworks before certain holidays which include San Jacinto Day, Texas Independence Day, Memorial Day, July 4th and New Years Day.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 2154.202(g), Occupations Code, is amended to read as follows:

(g) A retail fireworks permit holder may sell fireworks only to the public, and only during periods:

(1) beginning February 25 and ending at midnight on March 2;
(2) beginning April 16 and ending at midnight on April 21;
(3) beginning the Wednesday before the last Monday in May and ending at midnight on the last Monday in May;
(4) beginning June 24 and ending at midnight on July 4;
(5) beginning December 20 and ending at midnight on January 1 of the following year;

The additional sales dates have to be approved by the commissioners court, there is is more about drought conditions not being in effect, and locations closer than 100 miles to the Mexican border can also sell for Cinco de Mayo.

Jeeze more silly regulation that needs to be repealed because, you know, selling fireworks NOT NEAR A HOLIDAY is to save children, or something.


I wish TX would stop trying to be a nanny state.

Actually, Texas has lenient fireworks laws except for the bottle rocket bs and the restrictive sale dates.

While you can only buy fireworks on certain dates, you can set them off anytime where it is legal to set them off.  They are usually banned inside city limits.  There are some distance regs from hospitals, schools, churches, etc.  Fireworks can also be banned during drought conditions.

You can't buy much more than sparklers and confetti poppers in some states.  Also, you can only shoot fireworks on certain dates in some states as well.  

It is funny to see someone from a “safe and sane” state see what can be purchased here.  Much like taking someone from a place like Great Britain to the Market Hall show.

i bet you wouldn't feel that way if your house was almost burned down twice during the 2011 fire, and other smaller fires since then
(even though those wern't started by fireworks- why give them a chance to do that)

i get road rage level pissed everytime i see some a-hole from Houston dirving thru what's left of the pine forest (on Hwy 21), pitching a lit cig butt
out the window,,,had a few fires cause of that also.

Not dismissing your fear, but it sure sounds a lot like "If it saves just one life".  If there are burn bans for a legitimate reason, enforce the ban on use, not the sale?  Let sales be dictated by the market.
