ok,i have heard conflicting reports, maybe someone can clear this up..once and for all (for me at least)

30 round PRE-BAN ar mags are legal to buy and posess (of course with a hi-cap endorsement on your ltc card) so here is my question : is it illegal to have new manufacture 30 round mags ? you cant buy them here, but can i posess them? as far as i know, the only thing that distinguishes them from pre-bans are the follower and the "for le/military use only" stamp.

when the mag manufacturers start making new mags, they will have no need to put the "military/le use only" stamp on them,so there will be basically nothing to distinguish them from pre-ban mags.

so,is it legal to have 30 round post-ban mags in MA ?

The real difference is that POSSESSION of LE or POST-9/13/94 hi-cap mags carry a 5 year Felony conviction/per mag (5 is from memory, so it might be more than that)!

Mfg techniques have changed since 1994 as well, so even if hi-cap mags aren't marked, an enterprising DA could still get a conviction.

As for AR15 mags, I don't expect a lack of supply for pre-ban mags for a very long time, so you need to weigh the risk of owning NEW hi-cap mags against the potential penalty if you are caught, bagged and tagged.

so it IS illegal to have a hi-cap (post ban) mag currently ? or is it illegal to posess a mag that says "law enforcement/military use only" stamp on it ? the law you are referring(actually the penalties) looks like it was written as part of the awb when nobody could buy or own the "le/military use only" mags. since that has changed and anybody can buy them and bring them into communist states like ours, i was thinking the law regarding the mags have changed.

and no,if it is not completely legal to own/posess new 30 round mags,i will not press my luck. im happy with having pre-bans and customizing them with green anti-tilt followers.

is there a website with the laws regarding hi-cap magazines after the federal awb subsided ? i looked and all i found was definitions of legal and illegal mass compliant firearms.

thanks again for your answer lens, and merry christmas to you and your family.

Gregory,

Thank you and a Merry Christmas & Happy New Year to you and yours!

It IS ILLEGAL to possess in MA. Here's the MGL on it and where you can find all the other obtuse laws (sub the Chapter & Section to get the text for other laws). I was wrong, it was 1-10yrs penalty for the 1st offense!!

www.mass.gov/legis/laws/mgl/140-131m.htm
Chapter 140: Section 131M Assault weapon or large capacity feeding device not lawfully possessed on September 13, 1994; sale, transfer or possession; punishment

Section 131M. No person shall sell, offer for sale, transfer or possess an assault weapon or a large capacity feeding device that was not otherwise lawfully possessed on September 13, 1994. Whoever not being licensed under the provisions of section 122 violates the provisions of this section shall be punished, for a first offense, by a fine of not less than $1,000 nor more than $10,000 or by imprisonment for not less than one year nor more than ten years, or by both such fine and imprisonment, and for a second offense, by a fine of not less than $5,000 nor more than $15,000 or by imprisonment for not less than five years nor more than 15 years, or by both such fine and imprisonment.

How can they tell when a mag was produced?
Link Posted: 12/26/2004 8:07:01 AM EDT
if it is stamped "military/le use only" it has to have been made after the 94 awb.

It's not cut and dry, but specific tool marks or contours of the mag can distinguish it. This would rely on so called "expert testimony".

Many have changed mfg techniques or materials in the past 10 years. This could be used against an unsuspecting owner (or someone who was trying to circumvent the law).

I've talked with GOAL about dropping the mag restrictions, but was told that we do not have enough friends at the State House to get this passed and they are going to concentrate on bills that stand a chance of passage this term.

Interesting.......I am stationed in Mass. and now have my non resident LTC Class A - ALP - not sure how the law effects me since I am living here - but a legal resident of Maine. All of my guns are from outside the state - I realize that "non-ban" guns would most likely be a problem.

Hi .. I'm no expert on the Ma laws. And they have lots of confusing laws! I have a Class A and even though it allows me to purchase weapons that accept hi capacity mags, it does not allow me to purchase mags that are over 10 rounds. Even with the national ban gone, Ma stiil does not allow citizens to purchase anything that holds more than 10 rounds. I have looked on the net and I can't even find a site that will sell/send ( pre or post ban mags) to MA and a few other socialist states. As for having pre ban mags already... ? ???? I would guess that at the minimum that they would be confiscated (even pre ban!).

you can buy pre-ban mags made in singapore at fourseasons. i went to the big e last month and bought a couple of pre-ban labelle's. or you can order from eagle firearms ( a site supporter) HERE i ordered from chris,.great communication, great packaging and fast shipping. no-one will send any current production high cap mags, but pre-bans are a diff story.

edit;after looking closely at those mags from eagle firearms,it looks like a date stamp is on them,so i dont know the legality of those mags in mass.shoot chris an email and ask if he has any pre-ban mags in stock.

bottom line, you can buy 20-30 round mags here with a hi-cap license.they cant say le use only or have a manufacture date after 9/94.

re-edit:went to the gun show in nh yesterday, they had plenty of pre-ban mags there for sale to anybody with cash....
