Three men. One mag. No Gun

Wow

So they found one mag and charged all three?

Correct me if I'm wrong but aren't preban 10+ mags still legal until next year? and it would have been a felony if it was a post ban, so how does this make any sense?

Isn't it illegal to have a loaded magazine while you are on probation not to mention the marijuana?

The article is written with so much emphasis on the 24 bullets and ONE high-cap mag they found, they almost forgot to mention the VIOLATION for the marijuana.

Probation terms normally prohibit possessing a firearm. I have never seen them prohibiting possessing a magazine (I don't think). The marijuana is a probation violation but it's still just a violation besides that

The pot could cause a violation but depending on history and the jurisdiction they might not even violate him for that...

The 24 rounds must have been in the magazine

That should be a violation if it's the first offense and it's inside the home though.  Misdemeanor would be outside of the home or 2nd offense inside the home.

The article links to 265.36 which deals with a preban mag that can hold more than 10 rounds but we all know how reliable the media is with this stuff.

So far every charge under the act that i am aware of is just a tack on charge. And i believe if pot is found in a house everyone there can be charged.

Now I remember that. He listed it on Facebook. Then was meeting in a parking lot. Not the best scenario.  But I agree he did nothing wrong

Turns out it was two men, one woman and one baby. They didn't charge the baby with any SAFE Act offenses.

Brown, 31, and two others - Diamond Y. Ross-Hardy, 29, of the same
address, and Blair Dion Odom, 20, of 157 Baldwin Ave. - were charged
with misdemeanor unlawful possession of a large capacity ammunition
feeding device, a misdemeanor, as well as unlawful possession of
marijuana, police said.

Brown and Odom were sent to the Onondaga County Justice Center jail.
Ross-Hardy was ticketed and allowed to remain at the residence because a
baby was present, police said.

Possession of the ammunition by itself would also be a probation violation.
