Sorry this is not firearm related, but I do need something clarified about NC Renter's Rights.

Our dryer just went out, and this is the 2nd replacement for a dryer. I called the landlord and he said its probably just the fuse, and he would come by tomorrow and check it out. He said something to the effect of "If it goes out again, you will have to replace it. The only reason the washer and dryer are in there is because the last renters left it".

However, according to NC's Renter's Rights if the landlord supplies appliances they must fix them. The examples are refrigerators and stoves, but I need to know that it includes anything provided by the landlord such as washers and dryers.

Any help?

Are the washer and dryer listed in the rental agreement / lease ?

If so, you're o.k., if not you're screwed.

But then of course, I'm not an expert...

It's been a while since I rented, but this is my feeling also.  If the washer and dryer are not listed in the lease then the landlord doesn't have to fix them.

Also, NC Renters Rights requires written notice of repair requests, not just verbal.

The landlord’s duty torepair promptly all plumbing, heating, air conditioning, and other appliances and facilities doesnot begin until the tenant has given written notice to the landlord of needed repairs.

The law does specifically state that the landlord cannot bypass fixing appliances through a clause in the lease since it is required by law. NC General Statute 42-42(b)

I am just making sure that it includes all appliances, not just certain ones. I also know that I must put it in writing, but I just want to make sure I am justified if it is not just the fuse.

With the washer and dryer being left behind by previous tenants.........the landlord is not liable for repairs to them unless he specificly listed them in the lease or renters agreement. Appliances in rental property usually only pertain to Frig, stove, water heater and HVAC. And I have seen rental houses without even a stove and frig...you had to bring your own. Check your lease and see if they are listed.


Good luck getting it resolved..........cause some landlords can be just plan A##H****

Thanks for the info, but just to clarify that the current dryer that may be FUBAR is not the original one left by the tenants. It is actually a replacement for that one by the landlord.

Will that make any difference?

see section § 42‑42 susectiion a item 4 of www.ncga.state.nc.us/enactedlegislation/statutes/html/bychapter/chapter_42.html


(4)       Maintain in good and safe working order and promptly repair all electrical, plumbing, sanitary, heating, ventilating, air conditioning, and other facilities and appliances supplied or required to be supplied by the landlord provided that notification of needed repairs is made to the landlord in writing by the tenant, except in emergency situations.




I would say if the landlord didn't supply the washer/dryer, you're out of luck
