Anyone know of any range preservation or protection laws?

a local range i go to is being threatened. Some people bought land next to a shootign range, and now they want the range shutdown. OF course, the range was there first.

The RO was somewhat irrtated. He's a real nice guy, but never used a computer in his life. I told him i'd look into it and see what i coudl all find.

Here's what I could find from the online WI statutes:

895.527 Sport shooting range activities. (1) In this section,
“sport shooting range” means an area designed and operated
for the use and discharge of firearms.
(2) A person who owns or operates a sport shooting range is
immune from civil liability related to noise resulting from the
operation of the sport shooting range.
(3) A person who owns or operates a sport shooting range is
not subject to an action for nuisance or to zoning conditions
related to noise and no court may enjoin or restrain the operation
or use of a sport shooting range on the basis of noise.
(4) Any sport shooting range that exists on June 18, 1998, may
continue to operate as a sport shooting range at that location notwithstanding
any zoning ordinance enacted under s. 59.69, 60.61,
60.62, 61.35 or 62.23 (7), if the sport shooting range is a lawful
use or a legal nonconforming use under any zoning ordinance
enacted under s. 59.69, 60.61, 60.62, 61.35 or 62.23 (7) that is in
effect on June 18, 1998.
(5) Any sport shooting range that exists on June 18, 1998, may
continue to operate as a sport shooting range at that location notwithstanding
all of the following:
(a) Section 167.30, 941.20 (1) (d) or 948.605 or any rule promulgated
under those sections regulating or prohibiting the discharge
of firearms.
(b) Section 66.0409 (3) (b) or any ordinance or resolution.
(c) Any zoning ordinance that is enacted, or resolution that is
adopted, under s. 59.69, 60.61, 60.62, 61,35 or 62.23 (7) that is
related to noise.
(6) A city, village town or county may regulate the hours
between 11:00 p.m. and 6:00 a.m. that an outdoor sport shooting
range may operate, except that such a regulation may not apply to
a law enforcement officer as defined in s. 165.85 (2) (c), a member
of the U.S. armed forces or a private security person as defined in
s. 440.26 (1m) (h) who meets all of the requirements under s.
167.31 (4) (a) 4.
(7) A person who is shooting in the customary or a generally
acceptable manner at a sport shooting range between the hours of
6:00 a.m. and 11:00 p.m. is presumed to not be engaging in disorderly
conduct merely because of the noise caused by the shooting.
History: 1997 a. 242; 2001 a. 30.
This section does not prohibit the application of a zoning ordinance to a sport
shooting range unless the range was a lawful use under the ordinance as of June 18,
1998. Town of Avon v. Edgar Oliver, 2002 WI App 97, 253 Wis. 2d 647, 644 N.W.2d

I think that about sums it up. I hate people who move in close to a range they knew was there, bitch about the noise, and then demand it be shut down. Tools.

True, but slight problem there. THat statute only excepts noise.

IF the property owner gets a slug in their house, they can more than likely get it shut down.

Well now.....I would have to put that on the "ghey" level for a couple reasons.

1. Mr. Imadumass builds his house some distance behind the birm....his fault, but if I'm understanding you right, the range can still be shut down, if a projectile happens to sneak over the birm.

2. The range in question, the property is to be built beside the range, not behind it. Get a yahoo out there spraying indistriminanty, you'll have a problem. Any other responsible gun owner you shouldn't have to worry about holes in the house.

3. Far fetched, but a possibility....."God I hate that range so much, I'm going to shoot MY OWN house and blame it on them!"

I would not put that past some people to do that.

WEll.... im not too worried. You've been to the range. THere's so much foliage and stuff... AND the berm.... i don't see how it's physically possible. The other thing that helps our case is that the local PD uses that range

Where is this range located?
We had a similar problem in Fond du Lac.

Richie Riches built a swanky subdivision near my range...after the first fall of sighting in, they threatened legal action to close us down.
One of our mmembers ( a lawyer)offered his legal service for free.

One letter from him and that was the last we heard from the rich folks.

Wisconsin Dells.

It's a nice place.... out in the middle of nowhere.. .a short drive from the dells.

RO lives on site, and he's a really nice guy.

$15 a year for a 50, 100 and 200 meter range. also has a separate 25m pistol range.

The nice thing is, the WI Dells police use this range as to train at. So it's gonan be hard to shut it down. But they might try pulling some "police only" shit.

I told the RO i'd find as much info as i could. He's not very technologically advanced, but could put together an M1 blindfolded. with one arm behind his back.
