There are several issues at play here. When daling with AKs you have the NYS AWB requirements and you have the Federal 922r compliance requirements.
You can have a "post-ban" AK in NYS with a pistol grip, detachable mag and a muzzlebrake if the muzzlebrake is permanently affixed, meaning that it is silver soldered over the threads so it can not be unscrewed, or it it pinned and welded so as not to be able to be removed. As a muzzlebrake does not constitute a flash hider, you may have a 74 style brake or a 47 style slant brake and not have it count as a feature, so long as it can not be removed.
The other issue is you must have a requisite number of US parts to place it in this configuration. Off the top of my head I don't remember how many for an AKM, six or seven. Most likely your receiver will be US made. A Red Star Arms fire control group is three more for a total of four. Throw a US made stock set on and you bring it up to seven. If the brake is US made, even better, but hardly necessary. Another easy compliance part is the gas piston. All of these parts are readily available from Tapco or K-Var or Red Star Arms.
So, if you want as close as possible to an authentic AK and still be legal, have the brake fixed on permanently, put enough US made parts in and you're fine.
