Nordyke decision could be in roughly 60 days - but no guarantees (i.e, 1 year).
A favorable decision would end up valid throughout the 9th Circuit.
Opposition could request rehearing en banc by the whole 15? judge panel of the 9th instead of the 3 (O'Scannlain, Alarcon, Gould). I believe that en banc request could well be denied.
I also believe that if Nordyke holds at this level, the Bradys do not want to go further - they do not want this to go to the Supremes with its current composition right now, esp 6+ months after Heller. Let's hope Scalia, Roberts, Thomas, Alito and Kennedy exercise, eat right, stay healthy, etc. to not be replace by an Obama nomination (Obamination?) and that any Obama nomination to replace a Supreme replaces one of the Heller minority (Ginsberg, Stevens, Souter, Breyer).
If another appeals court circuit ends with a similar case that differs from a Nordyke-in-our-favor, that sets up a 'circuit split' for the Supremes to resolve.
