Local dealer telling me new rule that we have to do the same wait on a lower as we would on a pistol . Anyone heard of this?

Yes, I have heard of this. The last lower I bought was for a pistol though and it was a complete lower.

I buy online, and my FFL starts the clock as soon as I submit the order- so when it arrives, I'm good to go to pick it up.



Considering I pay $70 for a stripped lower shipped, and $20 for the transfer, I find it hard to buy a stripped lower from a normal shop for $130+ anymore

My understanding is that the transfer of a stripped lower is neither done as a pistol or a rifle, it is done as "other".  All "others" fall under the 3-day wait in Illinois.

An "other" is neither pistol or rifle. As such, it is treated like a pistol, even though its not (as in you can't build a pistol out of it)  

The question is, if it had a stock screwed on it, is it then a rifle?

Never even looked at the hometown thingy, didn't know what it was. Funny, been here 10/11 years (formerly as RogerN- couldn't figure out how to transition when
Insight became Comcast, so just started over) and never payed much attention, I guess.

Technically, this thread is about matters particular to Illinois hence it was moved to this forum. There was never a reason to lock it other than to move it.

That part in red - that's incorrect. A lower receiver can be built into a pistol as longer as it was never built into a rifle. The inverse is not true. If the lower receiver was ever built into a rifle, it cannot be built into a pistol.

my fully assembled lower picked up locally required a 24 hr wait, but as I understand it a stripped lower takes 3 days.  so, something I can immediately slap on to an upper of some sort is "less dangerous" than something with no parts in it that has to be assembled?

Because.  

IT doesnt make a lot of sense but some gun laws are there with no logic behind them and law abiding people have to follow them.

The exemption from the 72 waiting period was only defined for longarms - that is, weapons intended to be fired from the shoulder, as opposed to handguns.

While a stripped lower is not a handgun, neither is it a longarm, so it defaults to the more stringent restriction.


This is what my dealer told me when I got a couple of lowers two weeks ago.  One was complete with a stock and the other stripped.  He said as long as an upper with a barrel was not on it, it was not a rifle, then it was treated like it was a pistol and I had to wait 3 days.
