I was driving through NC (I live in NJ) and got pulled over on I-95 in the vicinity of Roanoke Rapids. Got a speeding ticket for doing 92 in a 70, one for operating a vehicle "without due caution and circumspection at a speed or manner so as to endanger",  and a ticket for not wearing a seatbelt although I had a seatbelt on have

Thanks.

P.S.
The cop asked me to sign something, but when I told him I was wearing the seatbelt all along he walked away. What was it that he wanted me to sign?

You will be getting some mail from lawers in the district you were ticketed in, hire one of them they will be able to get it reduced to a lesser charge usually something like improper equipment. I did this for my son who had a wreckless driving ticket cost 200.00 but saved a bunch in insurance increases. He did not have to appear in court either and you probably won't as well. The Troopers here are ruthless to out of state motorist. Good Luck with it!

If memory serves, over 80 MPH is a felony here.  Get a lawyer.  Also consider a Valentine one, $400 upfront is cheaper than a single ticket combined with the insurance hike, or even best case scenario having a lawyer to get it dismissed.

Get the attorney.  I got a speeding ticket last year and took everyone's advice w/ hiring an attorney.

That was the best $$ I could spend.  Ticket was reduced to  Non-moving violation for "Improper Eqpt", no points, no insurance rate increase (could have been 40% increase w/ the 4 points).

I've not gotten a ticket in NC.  Although, I usually don't do more than 10 over.  I have a Escort Passport 850.  The circuitry in it reduces some of the chatter that the Valentine picks up, and I find I'm more likely to pay attention to it.  The Valentine is more sensitive, but I found that I ignored it 50% of the time becuase every microwave and automatic door opener within a mile would set it off.  The Passport does a better job of identifying actual threats, and can be had for about 120 less.

I wouldnt be so worried about the speeding ticket, but would focus on doing something with the reckless driving ticket you got.  Honestly, I'm surprised you didnt get arrested if he drop a reckless ticket on you.  If I pull you for reckelss, you will be driving off inmy car, not your own.

I'd give you the fine amounts, but I dont have my books with me.  Total costs (before lawyer fees) is easily going to be several hundred.

He wanted you to sign the tickets since you are from out of state.

My style of driving and the areas I frequent are best served with the V1.  Its a ford vs. chevy debate, you have people who are die hard on both sides.
I memorized my route, I know exactly when and where the false warnings show up, I pay attention to how many there are.  The thing I like is knowing how many are there.  I can pick up a strong signal in the same place every time, but with the bogey counter I know whether or not to ignore it.

show up in court, if you can't get a lawyer that will represent you, you can minimize the charges in 2 steps:  first you or lawyer will get a chance to talk to the DA and get the speeding reduced to 9 over, maybe get the other charges thrown out, then step 2, ask for a Prayer For Judgement which is like No Contest but you don't get any insurance or driver's license points.  Then there's the third method like what happened to me last year: I showed up on appointed court date, they didn't have a record of my citation but I asked for a Prayer For Judgement anyway, then I got a letter saying my case was continued? WTF?  Showed up to court again, told the judge I got a PFJ the month before and he rentered it and dropped all fines and court costs

So you lied to get the PJC?

The judge should have held off until the actual status of the case could be proven.

From what I remember, the fine for the speeding itself will be about $30 plus court costs. Which will bring it to about $130. But I am taking that from what I know in both Wake and Dare counties, I've never gotten pulled in Roanoke Rapids.

Someone else suggested hiring a lawyer.... DO IT! I wish I had on my first ticket because that ticket came back and bit me in the butt three times, one time ending up with a very angry state trooper who was told my license had been suspended even though I paid the ticket... twice. Gather up those lawyer letters, read each one over, and chose the best deal handed to you. If you don't happen to get one (being out of state and all) let me know... I can give you the names and numbers of two excellent lawyers.

I've been pulled a few times, if you can't tell. LOL!

Nope, I got a PFJ the first time, showed judge my original citation, they didn't have their copy, I didn't want to make a second trip to the courthouse, so any she signed my pink citation, told me to go ahead and pay the cashier and I was good to go.  The cashier needed the copy the judge's clerk of court gives you, not the original, cashier sends me to another department to put my citation "in the system".  Other department can't tells me to go back to see judge, well I see the clerk and clerk tells me to call this number for next week or so and when my citation is "in the system" I can pay the fine.  Well it showed in the URL posted above, and I got a letter to go to court again.

I had the optjion of paying the fine before the court date and to avoid the second court appearance and since I had to go to the court house to pay the fine anyway, I just waited for my second appearance cause I had a feeling they didn't record my first PFJ.

I showed the second judge a copy of my original citation where the first judge signed off on the PFJ.

Was a clusterfuck, but it ended in my favor and lucky I guess I live in the same county the ticket was issued so going to court wasn't a big thing.

For you NC residents if you get a ticket or one reduced to 9 over or less over the limit and you have no other traffic tickets in the last 3 years, that <= 9 mph speeding ticket can not be used by your insurance company to jack up your insurance rates

from http://www.ncsu.edu/stud_affairs/legal_services/legaldocs/Trafficpoints.htm

   * 1 Point
Speeding 10 mph or less in excess of a speed limit of less than 55 mph*
     Any other moving violation.
Each at-fault accident that results in total damage of $ 1,800.00 or less * 3-4-2005

*Points are not assigned for these violations unless the same driver has been convicted of at least one other moving violation during the experience period (the last three years).

OK.  How your first post read, it came across like you asked for the PJC, but just recieved a continuance and then told the judge you did get a PJC.

The fine for speeding should be dependent upon the actual speed involved.  The reason this particular case is a mandatory appearance is 1) the speed involved and 2) the reckless driving charge.  The Reckless charge is a lvl 2 misd if I'm not mistaken.

Mine were all about the same as his. I think I had 61 in a 45, 46 in a 25, and 74 in a 55. I fought the 46 in a 25 myself because I got pulled over driving a truck that couldn't do 45 up a steep hill, which is where he clocked me. But, I digress. I didn't get reckless, though. I'm not sure why, but thankfully I didn't and I am not going to complain! My fines were about $30, plus the $100 in court costs, and we won't discuss the lawyer fees. :)

You should consider yourself luck. Unless I'm mistaken, 15 mph over the speed limit can result in arrest and license revocation on the spot. In excess of 80 mph can result in arrest and license revocation on the spot. Same thing for wreckless driving charge.

Hire a lawyer, pay them well, do what they say and hopefully you'll come out ok. And FYI, a few years ago, (2001), a wreckless driving conviction (reduced from 91 in a 55 and pre-arranged racing) resulted in a $400 fine and $110 court costs. My insurance went from $130 per month to $344 per month for three years. It was four points with the DMV and 7 insurance points.

Now, for the preachy part. I know all of us are grown men and don't need to be told what to do, but... Good luck and slow down. I did. Arrival at your destination a few minutes earlier is not worth the cash involved or your life. I'm a converted speed freak. My two beautiful step daughters no longer have a dad because of speeding on a wet road.

Do you guys have any idea what the fines for these violations are? Any tips on beating these tickets? Also, does NC have a point system?

Thanks.

Any speed over 55 and over 15 above the posted limit requires a court appearance. LEOs do not have the discretion to set the fine. The amount of the fine is to be set by a District Court judge. The cost of court in NC is $110, so you are looking at at least that  much $$$

The careless and reckless charge count also requires a court appearance.  Both this and the speeding charge are misdemeanors. You could be arrested for either offense. My quess is the officer felt you were following too closely or changing lanes too quickly. Also, you could have been charged with a new violation of "aggressive driving" which requires a speeding offense and a specific moving violation, and C&R is one of them.

He was probably asking you to sign the "resiprocity agreement" in the signature box of the citation.
This is your affirmation that you understood the consequences of not taking care of the citation, ie, revocation of your NJ license if you fail to appear.

I would find me a lawyer in NC and try to get the charges down to an equipement violation with large fine. Or, you can come back if your time is not too valuable.

Thanks for your replies, everybody - really cleared up some things for me. I think I'm going to go ahead and hire an attorney. Getting a lawyer seems like the most reasonable thing to do, and especially if that'll relieve me of the mandatory court appearance.

Actually, mine tells me if there are different/more than one signal.  It just lacks the directional arrows.  It's interesting, there's a traffic camera on I-40 near the 540 split that always sets it off.  X band.  About a month ago, I was headed through and it set it off like usual, but then started chirping K band.  Low and behold, there was an NCHP on the side of the road taking advantage of the radar decoy...

Well I had the opportunity to borrow one and try it out before I bought it.  I took it 4300 miles on a journey across the great plains and to colorado and back.  You know that trap where there are multiple bogeys and you think there are all behind you and then there are more up ahead?  I must have seen it five times on that trip.  I was sold.  Around here is really isn't much of an issue, and I rarely encounter radar enforcement anyways.  Its just nice to know where they are just in case I am not watching my speed like I should.
I haven't played around with the passports at all, but many of our customers have the built in K40 system and swear by it.  I think its horrible, no better than a cheapie wally world detector.  I had one, and I know they don't work well.  I am very pleased with my valentine though.  I have mine hardwired in, and mounted up out of the way.  I bought the concealed display, but don't use it as I just haven't found a need for it in my car.  If freaks me out to see how many folks put their detectors in places that render them useless.  Behind the windshield wipers, down low sitting on the dash.... I found having it up higher makes it pick up better, and gives you that split second when cresting a hill.

Yeah, as you can tell, I'm happy with the passport, but different strokes for different folks.  I'll say this for the Valentine, they are definitely good units, and I didn't lose much selling it on Ebay when I decided to switch.  They hold there value.  I've gotten so used to driving with the radar detector, it makes me nervous not to.

I've never picked up laser with it, of course I've only seen laser in use one time.  If it wasn't so difficult to use, it would render radar detectors obsolete.
Link Posted: 1/23/2006 3:31:46 PM EDT
[#24]
I have been hit ONCE that I know for certain was laser.  I forget which state it was, but it was a running continuous speed trap through work zones.  All radar the whole way until the very end, leaving the work zone area, I come up over a hill and BAM the V1 goes berzerkers and I see a trooper standing there running a laser gun.  Radar can be detected far off, unfortunately laser cannot that I know of.  He didn't get me, but I am sure he got plenty others.  The down side is Bojangles signs, trail blazer third brake lights, and  a few other things will set it off.
Above and beyond anything, there are those detectors marketed to the masses that for $100 or less promise protection.  They simply cannot and do not work.  There ability to pick up radar even at threatening distances is poor.  If you are looking, prepare to spend the bucks and get a "big boy" model.  As I stated before, I will gladly pay this money up front and avoid the potential of paying thousands for having gotten a ticket.  Insurance is already too high, and I would rather not give the bastards the opportunity to charge me any more.

Rant done!

NOW, pay the lawyer and take whatever you can get a deal on. THATS right, we want your hard earned NJ moolah! Stop driving like an asshole before you kill someone or yourself. I KNOW there is NOTHING  going south, north, east OR west that is worth dying for, it will be there no matter how soon or late you get there!

I drive for a living, it is an 80,000 lb big truck. You drive a 2500-3000 lb can. Who would win in a crash? ME!
I used to care if I ran someone over, I even planned on taking my life in a "unexpected" situation to keep someone else from dying. NOT ANYMORE, you running me down at 92mph, I would not even TRY to move.

I hope you realize that driving is probably the most dangerous thing you will do in your life (well most people anyway). Every Class "C" driver out there has no clue what a 3500 lb. projectile can do!

click the link below if you think I am full of crap! it only goes to 2004 though.
