Investigation of Robbery Death Continues

Buffalo, NY (WBEN)- Buffalo Police are still reviewing the circumstances surrounding the Friday Night shooting at an East Side Social Club.

Witnesses say gunplay ensued when two teens kicked in a door at the Smoke Shop on Genesee Street, and then fired their guns for effect.

A patron at the club, licensed to carry firearms, shot back and killed 16 year-old Dwayne Rodgers. It is believed that Rodgeres accidentally shot his cohort, 16 year-old Zontail Warren. He was hospitalized for his wounds.

The only charges pending are against Warren, who faces a robbery rap with perhaps more charges pending. The patron who shot Rodgers will NOT be charged.

On the buffalo TV news the youths were made to sound more "victimized" than the old men though.... Only sad part was that both punks didn't die.

Robber Shot By Card Player At Seniors Social

(Buffalo, NY) AP 09/27/04 - One 16-year-old is dead and another is wounded and charged with armed robbery after gunfire erupted at a senior citizens' social club.

Buffalo police say the two teens entered the social club Friday night wearing masks and carrying a shotgun and pistol, and told five card-players not to move.

When the shotgun went off, a 64-year-old card player pulled out his handgun and fired, hitting one of the robbers. The robber's shotgun went off again and wounded his accomplice in the arm.

Police say 16-year-old Dwayne Rodgers of Buffalo was killed, and 16-year-old Warren Zontail was wounded and later charged with first-degree robbery and weapon possession.

The card player, whose name wasn't disclosed, wasn't charged.

One 16-year-old is dead, and another is hospitalized in Erie County Medical Center following a failed robbery attempt, according to Buffalo Police.

Shortly before 10pm Friday night, investigators say two teenage boys burst into a social club in the 700 block of Genesee Street. One fired a shotgun at several senior citizens as they played cards. None of the members were hit, but someone in the club fired their shotgun back, killing one teen and wounding the other.

Police say the person in the club who fired back is not expected to be charged.

"He had a pistol permit," said Lt. Jim Lonergan. "The holdup men fired a shot as they entered."

Dwayne Rodgers, 16, was killed, and Zontail Warren, 16, remains hospitalized at ECMC in fair condition according to police, who said Warren faces robbery and weapons charges. Additional charges are possible.

Chaplain Kenyatta Cobb with the Buffalo Police Department walked past the club Saturday. It is the kind of tragedy he and community activists have been fighting, particularly this summer in Buffalo.

"What you have is a small element, a population that continues to live in that norm. The vast majority is pressing on towards spiritual, social, and economic development," Chaplain Cobb said.

The families of the teenagers declined to comment.

Rodgers is the 39th crime-related death in Buffalo this year.

Man Will Not Face Charges in Connection with Friday Night's Shooting

(Buffalo, NY, September 26, 2004) - - A Buffalo man will not face charges in connection to a Friday night shooting that left one teen dead and another injured.

Police say two 16 year olds broke into a private social club on Genesee Street, demanding cash from those inside.

Police say Dwane Rodgers fired a warning shot, which hit his accused partner in the arm.

Investigators say someone in the club then returned fire in self defense, shooting Rodgers to death and injuring Zontail Warren. Det. Sgt. James Lonergan of the Buffalo Police Dept.: "Just two young kids, it's unfortunate, like i said, i mean i don't know what they expected to get outta this social club, but unfortunately one has to die, and the other one's in the hospital shot."

Warren is in stable condition at ECMC, and under police guard.


Dear Det. Sgt. James Loergan,

You are an idiot. The only thing that was unfortunate was that one of them lived and the taxpayers will have to pay for his medical expenses and incarceration for the next couple of years. When he is released and resumes his chosen profession maybe he'll blow away one of your fellow officers.

Armed robber fatally shot at social club

A 64-year-old man gunned down an armed robber Friday night in an apparent act of self-defense during a card game at a social club on Genesee Street, police said.

A second suspect - a 16-year-old Woodlawn Avenue resident - has been charged in the attempted robbery, after being wounded during the exchange of gunfire, police said.

The shooting occurred about 9:30 p.m. in 743 Genesee St. - described by police as a social club where senior citizens gather to play cards.

Two masked men - one armed with a shotgun, the other with a pistol - showed up and told the five people playing cards not to move, Detective Mary Gugliuzza of the Major Crimes Unit said.

A round from the robber's shotgun went off and a man playing cards hit the floor.

Meanwhile, the 64-year-old man, who also was playing cards - apparently believing his friend had been shot - pulled out his gun and returned fire, police said.

"One of the patrons, who has a pistol permit, pulls out his handgun and shoots at the guy with the shotgun," Gugliuzza said Saturday.

The bandit armed with the shotgun was shot and killed, police said. As the robber was hit with the bullet, his shotgun went off and hit his accomplice in the arm, Gugliuzza said.

The dead robber's identity was unavailable.

His accomplice, meanwhile, ran from the building and flagged down a motorist, who drove him to Erie County Medical Center, according to police.

A short time later, detectives charged Warren Zontail, 16, of the 100 block of Woodlawn Avenue, with first-degree robbery and criminal possession of a weapon.

The scene of the shooting is a small storefront on Genesee, between Johnson and Grey streets. There was no sign on the building and the doorway was closed by a locked gate.

No charges were lodged against the 64-year-old card player, whose name was not released.

Okay so my question is, since someone died during the commision of a crime (armed robbery),
doesn't the other guy, the one wounded by the dead guy, catch a murder charge also?
