I have been over at silencertalk.com and the guy who got detained in Nashville for OCing the AK pistol is looking for a holster so that he can open carry a pistol with a silencer on it.  Watch for it on your local news...

Last I heard, his HCP was revoked, so he won't be open carrying any firearm.

He left a comment on a Tennessean article (about his legal problems) where he stated that he has obtained non-resident permits in other states, but that Tennessee won't recognise those permits.

Seems the Tennessean would have run a front page story if that had happened.  They love to try to portray him as an example of Tennessee carry permit holders, but a quick search of their site shows that he has switched to looking for traffic laws to comply with in a manner that causes officers to stop him and then write him a ticket after he starts lecturing the officer on Tennessee traffic laws (no mention, in the articles, of his carry permit history).

Let's hope that this has not occured to him, and that he stays focused on his more recent efforts at getting a cop to write him a traffic ticket that he can protest.

Correct me if I'm wrong. But it's my understanding that even if you have a HCP, it is illegal to carry a handgun with a suppressor. It being class 3.

Seems like I read that as well as an SOT that sold suppressors telling me that.

He is going down a road that will get him in all kinds of trouble.  Even if he has a valid TN carry permit and has a ATF Form 4 on the suppressor, if he carrys it he may just lose everything.  Shooting someone, even in self defense, with an NFA item is bad news!

I'm just guessing on this one but I'm sure ATF would not be thrilled about an NFA item being carried for self defense by a Joe Blow.   My logic is, ATF could revoke his Form 4 and take his suppressor for not using it as he had listed on the Form 4.  I'm pretty sure ATF would say no on a Form 4 if you listed "to make my AK pistol not so loud at the park".  Don't get me wrong, I think "firearms mufflers" should be title 1 firearms at the most.  I love mine and so do the folks in the neighborhood.

I wasn't (still not) trying to stir anything up, but I hear that all the time, and so far no one has been able to explain why or give an example of a time that it was true (other than suppositions like yours). I think it's kind of one of those 'generally accepted facts' that no one knows where it came from

Now, in the case of this dude, I agree, anything he is doing is going to only make things worse. However, outside of him, I still don't understand why it would be worse. Oh well, I'll keep asking when it comes up

I'm not a NFA expert, but I don't think the ATF can just "revoke" your stamp.  The stamp is not a permission slip.  It is a tax on a transfer.  If you have it, it means that you paid for a legal transfer. So long as you do not do something which would make you prohibited from owning a title II firearm and they can't prove that your transfer was invalid (i.e. Invalid Trust) they can't take your can.

Also, the "reason" section of a form 4 is not required for a silencer.  Or it could say "All Lawful Purposes" like mine do.

To answer the original question, I think the thought of using an NFA item for self defense being "bad" comes from the public misperceptions that silencers, machineguns, “sawed off” shotguns, etc.  are illegal and only used by hit men and terrorists.  As far as I know it is not illegal to use them in self defense or even in this case have a silencer on your carry gun.  I think it is stupid, impractical, and being an attention whore, but not illegal.

there have been a couple of well documented cases of people using machine guns in self defence . One guy even used his S&W 76 9mm on two seperate occasions . No charges on him , even though most say all the things he did the second time would land you in jail / broke for life etc .

I suspect the legal question about his plan to carry would have more to do with the state laws, than with the BATF and NFA.  Tennessee's carry permit allows carrying a handgun.  Does the state restriction against carry extend to the carrying of a suppressor, or does it only apply to handguns(without a permit), rifles, shotguns, machineguns, SBR's, AOW's...?

In a comment on an early Tennessean article about his legal problems, he stated that he was not doing this for gunowners, but because HIS rights had been violated.  He apparently threw in the 'if they can do it to me, they can do it to anybody' routine when it became clear that nobody supported his efforts.

He has done one thing for gun owners... When the anti-carry crowd starts going on about how a crazy person can just get a permit and walk around armed, and nobody can do a thing about it, we can simply point out that he has proven not only that the state can do something about somebody with a carry permit acting crazy, but that the state will do something about it.
