What is the offense if someone does not have their permit on them while carrying in VA?  I not advocating to do so, but I would like to have knowledge of the consequences.  

The person issued the permit shall have such permit on his person at all times during which he is carrying a concealed handgun and shall display the permit and a photo-identification issued by a government agency of the Commonwealth or by the United States Department of Defense or United States State Department (passport) upon demand by a law-enforcement officer.


If one does not then what happens?  I may have missed it in the code.

I  suppose that the permit holder gets charged with CCW w/o a permit.  Normally, the permit holder should be GTG, the CCW permit does come up during a wants and warrant check. If the permit holder is sober, not an ass, and identifies him/herself as a ccw permit holder, and then can't find it when asked, at least you attempted to comply with the law.

You could get charged, but I haven't heard of anyone getting a citation for this.

Odds are that it would be charged as a class 1 misdemeanor, carrying a concealed weapon without a permit.  The permit is effectively an affirmative defense to a violation of 18.2-308, so if you are not in compliance, by not carrying your permit (or ID) then technically it is a violation as if you had no permit at all.

even without your card on you it is linked to your DL so if they run your license they will see you have a carry permit. but as the code says you should have your card with you at all times. mine stays in my wallet and that is always with me.

Are you asking what'll happen if you happen to accidentally forget it at home, or are you asking what'll happen if you refuse to show it on demand by a LEO?

Cuz the first one you'll probably get a warning for, the second one you'll probably get shiny new bracelets.

Police have a hard enough job to do allready (including dealing with their own asshats on the force) dont give the man a reason to give you new bracelets and at a minimum a half hour detainment while they try to figure out shit.

If you are that paranoid about not having it photo copy a bigger copy of it and secure it in the holster somehow, thay way if you forget your permit and get stopped you will have that at least.

But concealed mean concealed.

I don't remember what the penalty is, but do remember that VCDL had a bill in this past session to change it to a simple administrative penalty (small fine). It didn't pass this year but will likely be introduced again.

That seems like common sense gun legislation to me (so shouldn't the Brady bunch be on board with it?).

I suppose I should also get around to making photocopies of my permit along with all the other stuff I am supposed to have photocopies of in our safe deposit box/fire safe. Makes sense to be prepared.

Guess it is a county thing. The one from Monroe county was legit.

My brother is in PA and they have a nice card that is not paper.  I am guessing when VA can legally charge more.  It is about the money, I am sure.

I was going to mention this but when I couldn't find it on the VA LIS website I figured it must not have passed.

Is it legal to copy it?  I have multiple holsters, guns, carry configurations...........


I dont see why it wouldnt be legal to have a slightly bigger or smaller copy, have it notorized maybe and laminate it and secure it with your carry gear. Its not like you are trying to pretend you are someone else. If you did get stopped for what ever I think an officer would be more simpathetic to you for trying to remain legal and have proof. I mean if you lost your wallet on the way to the store but you where carrying I think this approach would work.

Im going to search the state code and see if there is anything on this.

thats probably because the state(well actually commonwealth) of PA issues the permit where Va its the individual counties that issue it. that is an assumption of course. locals will do things as cheap as they can to maximize the income where the state will just charge a shit load to just waist tax payers money. LOL. dont forget that the price for a carry license isnt the same everywhere in Va. the states says the local COCC "shall not exceed $50" i think the first time i got my license it was no where near that. cant remember what it was and come to think of it, i cant remember what my renewal charge was this last time. as for making a copy, as mentioned above, im not sure how well that will fly since the license has an actual signature of the COCC. that would be a question for your local CA whom should be able to take your call if he/she isnt in court when you call.

the size of the license as well as what to do/how much you get charged for a lost/stolen license is spelled out in the code. making a copy isnt listed but the size sure is. see my post above about getting the real answer. it might be worth the phone call.

I'd like to see it cost less but I'd rather have the CHP be a piece of paper. Having the state switch to a DL type ID card would make it harder to go in the opposite direction for constitutional carry IMO.

I'd support this. However, I would like to see a more sturdy permit issued. I once showed my permit to a Florida cop who had never seen one (friendly encounter, not official business) and he looked at it for a minute and said; "What, did you type this up yourself" which is exactly what is looks like to someone who has never seen a VA permit.

I don't get too worked up over the paper permit itself- truth is, when they run your info they already know that you have one issued to you, regardless of whether you show it to them or not.

Just don't try it in Canton, OH.  

WV is a crappy piece of paper too.  Used to be FL used drivers license quality and you could bypass the NICS check with them.  That was cool.
