I went into the Monticello Racino yesterday and noticed a sign on the door stating "absolutely no firearms allowed inside".  As far as I know there are no laws that state that, if I am wrong can someone please correct me...

Notwithstanding = Despite.

So a local jurisdiction can make up any restricted places they want, but they don't matter. Your license is good anywhere in NYS, except NYC and schools, as laid out in...

S 265.01 Criminal possession of a weapon in the fourth degree
(3) He knowingly has in his possession a rifle, shotgun or firearm in
or upon a building or grounds, used for educational purposes, of any
school, college or university, except the forestry lands, wherever
located, owned and maintained by the State University of New York
college of environmental science and forestry, without the written
authorization of such educational institution;

and the usual federal no-nos (courts, federal buildings etc.)

I mean, is there a NYS law that restricts carry in casinos or racetracks? I don't think so, but I could be wrong.

If you get "made" in a store/business that has a no gun sign posted at the entrance, the most they can do is tell you to leave, in which case you must oblige, but there is no legal angle involved.



What I've always wondered was if you go to a courthouse and you have a gun on you, is it better to leave it in the car where it might get stolen or bring it with you and surrender it to an officer for safekeeping until you leave?

Id avoid taking it, if i could. But i suppose if you got stuck somehow, id leave it in the car and ask the officer if they can hold it.

isnt there some old old law regarding entering businesses in Albany, where they can essentially confiscate your weapon(s) if your on their premisis?

As silly as it sounds, if someone goes to Albany, to a club or whatever, and they dont drink...it isnt a bad idea to carry.  A friend of mine ended up in the river, and that was the last nail in the coffin for proof as to how dangerous simply going out with your friends at night can be.  I normally bring something if i end up in Albany, not the safest place.

I wasnt sure about the Racino (Saratoga one), according to the website if I recall has a no weapons policy...though id say double check that to be sure.  Being a state-run facility, it doesnt make it offlimits?

if ur doing it right no one will even know anyway.

thats the way I look at it, I was looking for a legal answer.  i think that they just put the sign up hoping to deter people as it is not illegal(as far as I know)..

Bingo. The sign means nothing, even if it is a state run facility. It's not a federal building, and you have a STATE issued permit that allows carry anywhere but schools and NYC.

And to answer the questions above, the Westchester case is trying to overturn/repeal the "good cause" requirement to get a carry permit...it's a tricky case to win with the activist judges we have, but legally speaking, and with the strict scrutiny/fundamental right wording in Heller, it SHOULD be won...

This will eventually make a suit in NYC possible, and maybe lead to easier to obtain carry permits.

I've never seen the penal code for no carry in mental hospitals, but it makes sense...they are prisons after all.

anything Katrina style happens here, forget that penal law....id rather end up in court than dead from roaming groups of thugs.
