David,
A what if... Question.
So if a "visitor" was visiting and did not know that Memphis had opted out, and the zoo wasn't posted properly, what would happen?
Yes I know ignorance is no excuse, and we must be aware of surroundings at all times, but seems maybe we need to Overcome the ability of place to simply Opt Out, not post and still be prohibited for someone with a Permit to Carry.
I know that would be in an ideal world, but since you always seem to be "in the know". Is there something in the works to correct this in the future? Amendment vote?
I believe that parks in municipalities that chose to "opt out" are off limits, period, whether they are actually posted (properly––as required by law) or not. One would
still be violating the law in such a situation. IIRC, a similar question was raised here in Nashville concerning the time between the law taking effect and the parks being
properly posted. Despite there being a built-in delay to allow them to get signs up...they still drug their feet & didn't get them up timely. One was still in violation of the
law if carrying, despite the absence of postings.
Ultimately, we hope to remove the local option from state law, thereby eliminating the patchwork that currently exists. I'm not sure where it is on the burner for this
legislative session. What I've heard discussed so far has been: parking lots, constitutional carry, and fixing parks comes in at third, at best.
Thanks,
I was just wondering what would happen if say someone from Florida, came to visit/vacationed here. Was unaware of the "Opt Out", and therefore since they had a CCW from Florida, did not see any signs posted, was spotted, and then LEO was called, and tourist was then confronted/stopped by LEO.
Same could apply to someone from Nashville area, visiting Memphis.
Not sure if all of the parks are "Opt Out" or if they are like Clarksville, where they just passed (slighty revoted to allow permit holders to carry in park) Problem, is they did not vote/approve carry in all the city parks, only certain ones are now legal, others are still a NOGO. The problem is trying to figure out which one you are legal in.
Yeah I know, concealed is concealed. Shame you have to be a "law breaker" while trying to do the right thing.
