IIRC sexual assault and murder have no statute of limitations, but charging a 19 year old adult for something they did when they were 10 seems .

I hada friend have a similar thing happen to him, not sure what the details were, but it all happened when he was 12.  He is a registered sex offender.  When he and his wife had thier kid, the state threatened to take him away, he will never be able to attend any school functions or be around any of his sons friends.  Pretty shitty when the system likes to make an example of someone.

Lets say these were heinous acts for this 10 year old, or my friend when he was 12.....a lot of things are enviroment driven at that age, why scar someone for the rest of their lives when they are obviously no longer a threat?

Am I being Naive?

Ahhhh didnt realize we gutted that part of the legal system too as part of the "sex crimes witch hunt"


Apparently before the victim turns 45 is the right answer for SOL.... Good luck finding exculpatory evidence from 30 years prior.....

Same sort of thing happens to the 18 year old guy who sleeps with his 16 year old girlfriend.  Registered sex offender for life if charges are pressed.  It doesn't even have to be the parents, it could be a tip to the DA and he decides he's going to make the kid an example.

If some dude sleeps with my daughter when she's 16, I would never press charges, you just will never see him again.

I seem to remember this one time.....after a few (dozen cases of) beers, you started talking about this time as an adolescent, where you met a bunch of aspiring (now current) politicians, and they did naughty things to you.....

You you think the legal system cares about "fair" or "right" you are a Naive fool. The only thing it cares about is convictions and how many people they can manufacture into criminals to perpetuate the system.



My 16 y/o son is finding out about this the hard way right now. Earlier this year he and another 16y/o girl casually had sex in the school auditorium during finals week. She confessed to her brother, her brother told the parents, the parents got the police involved. They both gave statements, the police decide it's "consensual" but since a 16 y/o can't legally give consent it's 2nd degree sexual assault. Boy is suspended for 2 days while the school decides if they will permanently expel him under some statewide assault rule (meaning he would NEVER be allowed to attend a public school). School decides 2 days suspension is acceptable. 4 months later the juvenile intake finally decides to act on the charges and informs us that even though the "assault" happened when he was 16 had the charges not been brought til he was 17 he would be tried as an adult and tagged a sex offender for the rest of his life. He's serving 10 hours community service and writing an essay on sexual assault laws in WI as part of the DPA.

I demanded that the girl be charged under the same technicality as he was, of course no one will either confirm nor deny that she was charged because she is a minor and I'm not privy to that information.

Wisconsin statutes of limitation, criminal.

First-degree intentional homicide, first-degree reckless homicide, felony murder, second-degree intentional homicide, first degree sexual assault of a child, certain felony violations of engaging in repeated acts of sexual assault of the same child: no limit
Second-degree reckless homicide: within 15 years
Theft, having obtained possession of the property lawfully and subsequently misappropriating it: within one year after discovery of the loss, but time limitation can be extended only up to five years
Second degree sexual assault of a child, certain felony violations of engaging in repeated acts of sexual assault of the same child, intentionally causing great bodily harm to a child, sexual exploitation of a child, incest with a child, certain child enticement, use of a computer to facilitate a child sex crime, soliciting a child for prostitution, sexual assault of a child placed in substitute care, or sexual assault of a child by a school staff person or a person who works or volunteers with children: before the victim reaches the age of 45 years, with exceptions relating to the use of DNA evidence
