I know this is not a gun question but im going to buy one and I cant decide. I wont repeat I wont use the axe for wood so that is not an issue. both are made from cold steel and both are about the same price.

Which one and why?

Go for the battle axe. Not only do you get good penetration but there is a intimidation factor involved. The hammer gives you good immobilization but it is an impact weapon and you apply force to a certain point. The axe will give you the added benefit of blood loss which can significantly impair your opponents ability to continue the fight.

i would thinmk that the spike on the hammer would make them bleed

I guess as far as battle axes go that one's a bit weak ... I'd save my money and get something much more ornate ... adds to the intimidation factor.

Get the shovel.  This way, you can dig your grave while your opponent plinks at you with a modern weapon.

I'm surprised that torpedo isn't classifed as an AOW.

If your not worried about the money. I know a place that makes sweet hand made knives and Ax's. I use to make knives for fun sold a few of them also I don't make any more do to that I live in apartment. But they do have one that is like the battle ax and the war hammer. On one side it has the ax and the other the long spike. It was so sweet it was forged from I want to say D2 tool steel but that does not sound right. If it where me I would go for the tomahawk there light easy to swing around. If you get good you can use it to throw also. I have a tomahawk that I made with a leather holder that fits on my back like a shoulder holster does the tomahawk is upside down in it so that when you reach back and pull it out is ready to swing. Another thing the ASP batons they are nasty thing to be hit with and there small and they look like a flashlight on your belt.

I vote Sjamboks, unless pitted against a Knight-in-Armor on horseback, then they lack functionality.

Sjamboks are used as a cattle prod, a whip, a riding crop, and a means of self protection throughout Africa. A light blow can
raise a serious welt while a heavy stroke can cut through thick clothing like rotten cheese cloth

Well in the world of Diablo II, which I'm playing right now, a war hammer does more damage, but is a slower moving weapon

But this one is small It weighs I'm going to say maybe 5 lbs so its not going to be that slow now if it was a nice 15 or 20 lbs then it would be slower. I still say go for the tomahawk the Native Americans used it and its a hell of a weapon.

War Hammer: Double ended, and works better vs armor. That spike would have to hurt.

Favorite line from a book:

"Just out of curiosity, if you were challenged to a duel, what weapon would you choose?"

"Ten-pound sledgehammers."

Get the Tomahawk, not the two-handed ax.  You need something that you can use with one hand while you have your rifle or pistol in the other.  Also the tomahawk is good for butchering large animals- you didn't think they carried them just for fighting did you?
