People who want to become immigrants are divided into categories based on a preference system. The [b]immediate relatives of U.S. citizens[/b], which includes parents, spouses and unmarried children under the age of 21, do not have to wait for an immigrant visa number to become available once the application filed for them is approved by the INS. An immigrant visa number will be immediately available for immediate relatives of U.S. citizens. The relatives in the remaining categories must wait for a visa to become available according to the following preferences:
First Preference: Unmarried, adult sons and daughters of U.S. citizens. Adult means 21 years of age or older.
Second Preference: Spouses of lawful permanent residents, and the unmarried sons and daughters (regardless of age) of lawful permanent residents and their children.
Third Preference: Married sons and daughters of U.S. citizens, their spouses and their minor children.
Fourth Preference: Brothers and sisters of adult U.S. citizens, their spouses and their minor children.

As you can see, being the spouse of a US citizen moves you to the head of the line.
Of course the vast majority of US citizen/alien marriages are legit, and giving them preference is the right thing to do. See captainpooby above.
To falsely claim this preference is a federal crime, and the INS will investigate.
Remember, you do not have to prove that a crime is occurring. You just have to decide if it’s your civic duty to report your suspicions.
