'BAD COP' WANTS HIS DUE

JOSEPH SIMONE: Blames DeVecchio.

October 7, 2007 -- Of all the people watching the trial of an alleged rogue FBI agent accused of leaking information to the Colombo crime family, disgraced former NYPD Detective Joseph Simone may have the most at stake.

The 22-year vet was arrested, booted from the force and lost his pension after he was fingered as a bad cop playing for the wrong side. Prosecutors now charge Lindley DeVecchio was the real rat.

“I resent him because of the actions he took," Simone told The Post at his Staten Island home. “He's got to face consequences."

DeVecchio, charged with orchestrating at least four homicides by providing information to Colombo capo Greg Scarpa Sr., goes on trial Oct. 15.

In 1991, Simone joined the FBI-NYPD Organized Crime Task Force, which DeVecchio headed.

Shortly afterward, however, he was accused of leaking information and not reporting a bribe. Simone contends he informed his superiors of the attempted bribe. Simone was arrested in 1993, booted from the force and stripped of his benefits.

For 13 years, Simone has waited to see DeVecchio's dirty dealings exposed.

“I would like to ask him, ‘Why me?' " he said.

Simone's wife has had to work two jobs and he battled bouts of depression. “When this happened I was totally devastated, I cried for a week."
