I'd still like to know why NOBODY understood the AWB.  Why does eveyone think AK will rain from the sky?  GWB could have made Kerry look like an ass if he just asked why he thought there would be a proliferation of AK-47s now.

I really don't think so, though my uncle made the same claim to once, based on his part-time work for the DA's office in his area. He showed me the badge they issued him, and he said that he carries. Good for him.  I guess it depends on what state you are in. In my state, prosecutors are NOT sworn Peace Officers, though they have commissioned investigators who are.

In Ohio, Prosecutors (AKA D.A.'s) are by law desginated as Law Enforcement Officers. As are State Troopers, Judges, and others. Police Officers and others are designated as Peace Officers. Ohio law has distinct definitions of the two.

Actually, Police Officers fall under both definitions.

Don't know where Kerry was a DA, but in MA they are NOT sworn LEOs! A very good friend (former state rep and senator) is our DA and he doesn't pretend to be a LEO.

All lawyers admitted to the bar (not the one that Teddy hangs out in) are considered "officers of the court", but they aren't LEOs either.

Not quite so simple. Every citizen has limited arrest powers. Not every Citizen is a Law Enforcement Officer.

I was never an LEO, but have placed people in confinement / arrest on many occasions.  By your definition, ALL military officers are LEOs - especially unit commanders.

Badges, we don't need to stinkin' badges .

Per the language in HR 218, now 44 USC 18:

(c) As used in this section, the term `qualified law enforcement officer' means an employee of a governmental agency who--

(1) is authorized by law to engage in or supervise the prevention, detection, investigation, or prosecution of, or the incarceration of any person for, any violation of law, and has statutory powers of arrest;

(2) is authorized by the agency to carry a firearm;


(3) is not the subject of any disciplinary action by the agency;

(4) meets standards, if any, established by the agency which require the employee to regularly qualify in the use of a firearm;

(5) is not under the influence of alcohol or another intoxicating or hallucinatory drug or substance; and

(6) is not prohibited by Federal law from receiving a firearm.


In WI no, they are not LEO's.  At least not in my area.  The State of Milwaukee or the Democratic People's Republic of Madison might do things differently.

In Colorado, yes. They are classified as peace officers by state statute. Is he claiming that in Massachusettes? Maybe someone should find the statute for that state.

(Of course I don't believe he ever did anything of value.)
