He has the rifle because he KNEW he would be in a gunfight today
(he probably ALSO has a pistol, I know I would)

He engages you at a distance of approximately 40 yards

Outside of 25 yards I'm not CONFIDENT in my ability to engage at that range. The pistol is used to fight your way back to the rifle you should have never sat down.

well I can hit a pop can at 100yards with my carry pistol, so 40 yards ain't a strech, course that pop can ain't shooting back at me either,

but I'd think that the best senerio I could hope for is to seek shelter, and make him miss till he got to reload, then shoot him.

People think I am nuts when I shoot my 1911 at 125 yards. But I've yet to run into a local who can hit a 12x12 plate more often than me at that distance.

Even if I had a rifle, I would likely be dead.  An ambush rarely goes well for the ambushed.

Still not enough.  If he has a bolt-action and it's out in the open, I do my best Barry Sanders impression with the intent to get close enough to him to engage with my pistol.  If there is cover I use that.  If he has a semi-auto, I do the "Barry" away from him.  If it's a congested, urban or suburban area, I probably don't fire from distance with the intent of suppressing him for fear of hitting a bystander.  The environment figures heavily into my course of action.

The intended question has more to do with the two to three shots you
might have the time to get off and your possible accuracy at that range

i will use it to show my wife why she should carry her XD-9.  She has a permit but never carrys becouse she says I always have mine on me.  It drives me nuts.... she is a great too

for me, I'd feel marginally competant with my carry g27 and moreso with any of my other pistols... assuming the guy is a lousy shot

I would go prone, then fire three shots in the air, when help arrives, I would let them deal with it.

In all reality, if running away wasn't an option, I would charge.  If he has already intiated an ambush and I'm still alive.  Time to really tempt fate.
