Hi gang. Cool site here. I just joined so I could ask you guys a few questions.

I'm writing a screenplay about gun contol. ATF/militia movement type stuff. It's basically an action movie that deals with all perspectives on gun control. (and it's already has a copyright so don't bother) :)

Anyway, I have a scene where an ATF compliance inspector catches a gun store owner with some sawed-off shotguns.

I was wondering, how do these compliance inspections work and what would happen after you were arrested? What is the penalty? Etc...

Any information would be cool.

i haven't the foggiest, though those with FFLs could prolly tell ya.

just for comparison, you should ask the ATF [b]AFTER[/b] you get the answers here and see how they compare.  particularly how the ATF answers compare with anyone that has been bothered by ATF.  mu guess is stories prolly won't match.

If you are writing a screenplay depicting a gun store owner, perhaps it would be better to portray the scene in a way that is closer to reality... why in the world would the owner of a legitimate gun shop risk his business and his freedom by breaking one of the more easily checked regulations? This scene would tend to show gun shops in a bad light, most undeservedly so.

You are writing an anti-gun screenplay for Hollywood, aren't you? (BTW: ask Randy Weaver about the consequences of creating a too-short shotgun...)

Actually this is a pro-guns screenplay, the way the movie 'Traffic' was in a sense "anti-war on drugs". It's underlying message being "The war on guns is something we can never win."

The gunstore owner in this script is actually based on Randy Weaver. I find that incident fascinating, especially the way the US government reacted.

The story is told purely from a "militia" perspective, with the main character being the head of a militia group in Texas, who sort of comes to the aide of the oppressed gun owner.


The reason the gunstore owner is putting himself at risk is because he is trying to support a family under deep debt, and selling marked-up weapons on the black market gives him a little extra cash...

I won't give much more story than that but I would really appreciate your help in describing how the ATF inspectors actually operate.

And ARlady, I thought you made some excellent points.

Penalty 10 years and/or $10,000.  Why would a gunstore owner keep illegal NFA items in his place of business where he knows there's the chance of a surprise compliance inspection?  After his arrest?  Well, I'm not too sure there, but I would guess the ATF would seize all of the firearms, not just the illegal NFA ones.

In the first place the guy that turned Mr. Weaver was a paid Informer, not a agent of the BATF.
It makes a lot more sense to sell someone a shotgun and let them hack it off than to risk going to jail over it. I can't believe that anyone would be stupid enough to keep a stock of sawed off shotguns around, if you bought one you would be stupid to pay more than list price for a leagle one. The risk and penality are the same for a machine gun as for a sawed off and the profit margin would be much higher on a machine gun.
But if you were really smart you would go to Mexico and buy R-12 (Freon) for next to nothing and sell it up here for about $1000.00 for a 30lb can, and if you got caught pay the fine and go home.

I agree with what was said before in that their isnt really any good money in running a gun store. I considered it, and would have loved to make that my profession as opposed to what I do currently.

If you are in fact trying to portray the gun industry in a good light,(which for the most part it it) then try not to have the central character be involved in something illegal. How about trying to have the owner do something LEGAL, but politically incorrect. Maybe have the government hassle the gun shop owner/industry and have the shop owner stick to his rights and beliefs. Dont make him out to be a good guy in a financial jamb to justify his illegal actions.

Confuses the heck out of me, but what do I know? I changed majors at USC from cinema to journalism in the middle of my junior year because I just didn't understand all those "creative" (and ultra-liberal) types and the screenplays they were always trying to write.

A closer story to the truth would be how the ATF targets certain dealers and does everything it can to put them out of business.  Like taking mugshots outside of the store in broad daylight, with the owner in handcuffs while they destroy firearms by throwing them across the room and then never charging anyone with a crime.

Or how about harassing class 3 owners and SOTs?

Militias?  I don't know a single gun owner that belongs to what you probably consider a militia.  The majour ones have open communication with the FBI (initiated a few years back) and most have had undercover agents join for a while to make sure things are all above board.

Penalties...you would be looking at a serious violation of the NFA if you lack the tax stamp for such a firearm.  Go look up the NFA and you can read about the penalties there.  Depending on the person, judge, etc they could end up with anything, but likely a 5 year jail sentence.

I get the feeling that this movie is going to be as "pro-gun" as that straight to video piece of crap steven segall movie "The Patriot" (NOT THE MEL GIBSON MOVIE) was pro-militia.

well if i were going to do somethng like that, i would go more like this..
guy buys shotgun (or assault weapon) legal from a gun shop.
then converts it to illegal class 3
gets caught
then sells out to atf for amnesty.
they storm shop but hes out to lunch.
he tries to streighten things up, but lost everything.
they catch him and beat the sh*t out of him then throw him in jail.
at this point some real reporter starts covering thins here. eventually this case gets national coverage.
long legal battle, he gets beaten throughout.
feds try to frame him when they discover the error of there ways bu paying people to lie for them.
but one person makes it to the stand and blows the hole thing apart.
the poor slob that told truth disapears before he could testifie against the feds.
but effects the release of the shop owner, after 6 years in the cooler, with not even an apology.
in outrage the firearms owners of this country satrt a revolution, and make him the head hancho.
revolution succedes, all stupid gun control acts are abolished.
