I see no problem with being responsible for your own equipment and actions.

Too many people in the world are eager to sue someone over a problem that they created themselves. And then we wonder why insurance rates are so high.

The part that worries me is where it says that I hold them harmless for their neglegence and that of others. If I hurt myself no problem, my fault. But if someone else does it no.

Kind of a funny legal document that attempts to make up for its various fallacies and shortcomings....I like how they go on to define "valuable consideration" as the bargained exchange. Forum selection is nifty too, I wonder if they actually have any out of state members or even any out of state contacts that would make a forum selection necessary. Waivers aren't absolute but they tend to filter out more frivolous lawsuits, did you have particular concerns?

Simple solution. Find somewhere else to shoot if you have a problem with signing a release.

Sign it or go home.

It's a pretty standard waiver, I have to sign them all the time for skydiving. I even have to sign one where I work to work there.

You can thank idiot lawyers and juries for teaching people that they are not responsible for themselves.

So, if you are shooting from a covered bench and the negligently constructed roofed structure collapses on top of you severing your spine, you should have seen it coming and should take responsibility for yourself?

I had a similar waiver drawn up for my business.

My attorney tried to talk me out of it, telling me that:
1) I will still get sued anyway, and the judge won't toss the case just because I have that piece of paper
2) If I am negligent, the waiver is worthless anyway.

In the case of the shooting range, if they're hosting a match and the covered firing line collapses, severely injuring the dozen people who were firing at the time, the range will get sued and will most likely lose the suit.

The enforceability (I'm sure that's not the proper legal term) of such documents can also vary widely from state to state.

I'd sign it.

#1 & #2 above are why anyone thinking about being a club officer needs to be sure the club has adaquate insurance.

I tripped and broke a tooth at the range. My dentist didn't want to submit the bill to my insurance because he said the property owner was responsible. I told him I wasn't going after a club I am a member of and I made him submitt the bill to my insurance company.

Anyone know what it takes to sue in texas $246.
That paper helps them feel better but you can always be sued or sue no matter what is signed. You can't consent to being harmed.
I"m in dental school and there is a lot of stuff we can't do even if the patient wants it and it would help them for a little while because anything that's not done "perfect", even if its used as a stop gap, could be considered malpractice. So just sign, if you get hurt because of some idiot sue them. If its blatant it shouldn't change anything.

I doubt if that paper would stand up in court, so if you get hurt and can prove it was through somene else's negligence, sue 'em anyway.

It is usually easy to get blanket waivers booted.

Of course if you sue your own shooting club expect dues to go up to help pay...

Our range has a similar disclosure. A few years ago a volunteer was up on a roof repairing it (for free) and another shooter broke several safety rules and shot the volunteer in the butt.

Long story short, the disclosure didn't mean squat as the volunteer was required to sue the club and the shooter for medical bills he couldn't aford to pay (retired). He didn't go after pain and suffering so most members of the club were understanding and respectful to the volunteer. Club settled outside of court, not sure about the shooter.

Actually, if you are negligent, no waiver in the world will save you. Not even that one. Those clauses are just to scare you away.

The dropzone I worked at back in the 70's had a blanket waiver for people to sign. One day, a lawyer showed up to make his first jump, read the waiver, and said, "You're kidding me. I could rip this thing apart in a courtroom." The DZ owner said, "I know, but most people don't know that."
