Why doesn't the NRA (or any pro gun group) [s] just call[/s] leagaly register them selves as a militia? Then any one in the NRA is officially part of a militia and gun laws magically go away. Sounds so simple and stupid it just might work. I know that the individual rtkba is guaranteed; I'm not arguing that point.

What constitutes a milita, where are the guideline regarding forming militia's, laws? So why can't www.ar15.com register it self as a "well regulated milita"?

You're already a member of the militia!! By law, every able-bodied male 18-45 years old is a member of the unorganized militia. The states are currently responsible for drilling and training the organized militia. They haven't really done anything about it since they performed so poorly during the Civil War. The NRA was originally established as a firearms training organization after the Civil War because Yankee generals realized that their troops couldn't shoot straight.

Why didn't I think of this! I think I'll start calling myself a Class III dealer! Oh wait! Maybe I'll start calling myself the Commander in Chief and then I can fly a Warthog and shoot the gatling gun!

The NRA has always tried to distance it self from the "m" word. There was a supposed informal meeting by marion hammer and militia leaders back in mid 90s that the adl/jdl found out about and pulled their usual bullshit "anti-semite" accusations.

The militia is ONLY considered the national guard according to all circuit court cases currently in existance. The Emerson decision in the 5th circuit is seeking to change that. THERE IS NO SUCH THING AS A CIVILIAN MILITIA! IT IS NOT LEGALLY RECOGNIZED AT ALL! I just wrote an extensive legal paper about the 2nd Amendment and the militia aspect of it. Email or IM me if you want a copy. You'll learn exactly what has happened in the courts and where our rights lie.

Hmmmm.....Thats EXACTLY what it is. Thats kinda like saying I am in the Army but not a member of the armed services. mi·li·tia (m-lsh) n. 1 An army composed of ordinary citizens rather than professional soldiers. 2 A military force that is not part of a regular army and is subject to call for service in an emergency. 3 The whole body of physically fit civilians eligible by law for military service. "I ask, sir, what is the militia? It is the whole people, except for a few public officials." George Mason (3 Elliot, Debates at 425-426) "The militia, when properly formed, are in fact the people themselves, ... all men capable of bearing arms;..." -- Richard Henry Lee writing in "Letters from the Federal Farmer to the Republic", 1788, page 169. "Who are the militia? Are they not ourselves? Is it feared, then, that we shall turn our arms each man against his own bosom? Congress shall have no power to disarm the militia. Their swords, and every other terrible implement of the soldier, are the birth-right of an American ... The unlimited power of the sword is not in the hands of either the federal or state governments, but where I trust in God it will ever remain, in the hands of the People." -- Tench Coxe - 1788. Sec. 311. - Militia: composition and classes (a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard. (b) The classes of the militia are - (1) the organized militia, which consists of the National Guard and the Naval Militia; and (2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia The militia were affirmatively required to furnish their own arms, ammunition and other supplies. This also distinguishes them from the National Guard. The modern definition of the militia hasn't changed.

SO then, it is simple the laws are unconstitutional, and we don't have to follow them. It is called civil disobedience!!! Problem is we (my self included) are to chicken shit to practice it, because of the harsh penalties, but enmass it would be a different story.

You're right, asshole, we are too chicken shit to practice it. However, I am part of the militia.

Why the fuk you calling me an asshole? It isn't civil disobedience if it is done in private, In order for it to work it needs to be done, openly and displayed publicly, en mass to the point that there would be no point in arresting everyone doing it. Which hopefully leads to policy change.
