Why nominate a new judge rather than someone already on the court, and tried and true?
I realize it is all speculation on our part,
but obviously it would be hard for Bush to nominate someone we would like more than Thomas.
What does he hope to gain?
Is Roberts that good of a guy that he is the best nominee?

Roberts was the late Chief Justice Rehnquist's protoge. I think it's mostly a gesture to Rehnquist's memory.

It would be one extra confirmation battle.

And it pisses of the Libs

There have been more Chief Justices that have not had prior Supreme Court members than have.

Bush is giving a kinder and gentler Fuck You to the court that is eroding our freedoms and rights. Basically he is telling Thomas et al...get your shit together and fight harder for what is right.

You don't really think they want someone that appears to be a conservative as chief justice, do you

Exactly. Bush would have to spend more "political capital" in the fight to get Thomas the job. Everything from his original confirmation witchhunt would be dredged up again, and Anita Hill will be on Larry King Live again. Plus, he'll have to answer for any decisions the media/Libs didn't like his stance on.

Doing a two-fer to get Roberts in is MUCH easier.

Yep - political maneuvering, plain and simple.

(Agitation of the Dems is just a happy side-effect. )
Link Posted: 9/12/2005 10:00:43 AM EDT
Cause he's BLACK.

Seriously I think I'd prefer Thomas. At least we KNOW something about him.

Roberts may be fine but he is a wild card. There was that Reagan appointee everyone thought was gonna be so great, remember...

Plus 1.

Especially after the dissent he wrote for Kelo. That was a good one.

That's why I really would have liked to have seen Thomas.
Tried and True.
And Bush could easily have made the argument, a true conservtive is replacing a true conservative.
I suspect Thomas is dissappointed as well.

Either Scalia or Thomas would be super. Very strange to nominate Robert for Chief Justice before he's even confirmed.
Link Posted: 9/12/2005 10:09:52 AM EDT
Roberts is younger, I suspect. That adds to his appeal as a longer-serving Chief Justice.

Bingo! He is younger so will serve longer and thus carry the influence farther into the future.

Actually, it's the norm. I didn't know that until I read up on it when Reinquist died. I was surprised. I would love to have Scalia or Thomas as CJ, but it looks like we're going to roll the dice with GWB and see if we wind up with a Scalia or a Ginsburg running the court.

Hey, thank your lucky stars it didn't occur to Bush that he might have gotten a couple more Hispanic votes for the party if he had nominated Gonzales for CJ.

Thomas would have been my choice.

It would be a bloodbath getting Thomas confirmed as Chief Justice.

Justice Thomas made it known he didn't
want the job.

Yeah, but it could have been fun to watch the Left (friend and hero to the oppressed minorities) go ape-shit over how he isn't qualified. Too bad their constituancy never seems to see the hypocrisy.

I think you've all missed the obvious choice....Scalia.

My kind of SC justice...if that's possible?

There are two vacancies.

But not for Chief. I know there really isn't much difference but...

If he's gonna throw down with Gonzales he needs to do it now. Roberts is so squeaky clean that the Left is going out of their minds. Throw Gonzales in and they'll pounce. We'll get Roberts as Chief and Gonzales will get hung out to dry.
Link Posted: 9/12/2005 10:33:50 AM EDT
Rush siad that there are whispers about Priscilla Owen of Texas being the next nominee.
Supposedly, she had a private meeting with Bush last week.

Compared to some of the truly conservative black and/or female possibilities under consideration, I would think the Dems would be tickled pink if Gonzales (moderate at best, IMHO) is nominated next...

A few reasons to ponder:

Justice Thomas is to conservative(according to libs) and his nomination for Chief Justice would be circus. Bush is choosing his battles. Why fight three when you only have to fight two.

Thomas has already been on the Court for some time and Roberts is younger.

The Democrats will have a hard fighting the next nominee if it is a woman either way.
