According to the state statute under which Johnson was charged, the weapon is considered a "machine gun,'' which is defined as "any weapon which shoots, is designed to shoot, or can be readily restored to shoot, automatically more than one shot without manually reloading..."

Furthermore, how is 400 rounds considered a stockpile? Albeit it seems like this guy was playing stupid games and won his prizes accordingly, but 400 rounds as a stockpile? That is like 2 maybe 3 range trips.

Yeah, I LOL'd at 400 rounds being a stockpile.

It is sad what they are going to do with that poor MAK90.

Pretty sure the feds were talking about pulls of the trigger...

That law seems to ban semi-autos too.

I think the additional 36 rounds of .357 is what sent it over the edge.

"What he didn’t have was a valid firearm owner's identification card, said Mirabelli, who added that it had been revoked. Johnson was arrested and charged with aggravated assault with a deadly weapon, unlawful use of a weapon for possessing the AK-47, and possession of ammunition without a FOID card, Mirabelli said."

Unfortunately that AK is destined for the incinerator.

400 Rounds is a stockpile

Guy was an idiot and brought it upon himself but the stockpile claim is retarded.

In Illinois, you need a FOID (Firearm Owner Identification Card) issued by the Illinois State Police to purchase and posess firearms and ammo.

Having a Foid card actually not a big deal, but this guy has two things going against him...his was revoked for some reason (not stated why in the article, however unless of a lapse, he did something to get it revoked) and where he's at (Chicago, Cook County) MAK-90's are banned by name.

ETA:  I know of plenty of people in Illinois who have firearms and don't have FOID cards and quite a few with FOIDS with no guns.  Never said it made sense, but legally to be in compliance with state (not county or city) law, he should have had a foid for the rifle and ammo (both otherwise completely legal here under state law)

wow they would totally shit if they saw a real stock pile.

400 rounds doesn't even qualify as a hobby.

Hell, most packs of .22 contain 500 or more....

Was the AK a Bulgarian milled receiver model?

Hey. It isn't just 400 rounds of 7.62 soviet. It was 400 rounds for an AK AND 36 for a 357. That makes it a stockpile. Did they really sit there and count out 36 rounds or was it in speed loaders? If they were in speed loaders then they are much more dangerous. All kidding aside, the guy was an ass.

If the past is any guide, it will become a prop used by the police at news conferences siezures of guns.

I have seen the same firearms laid out on the table for the media several times.
It's not very dramatic to show the media a rusty .22 revolver and a .25 auto with a broken grip.

I'd like to see an up close pic of the receiver.  Weren't some Norincos brought into the country with a hole for the 3rd axis pin?  I'm hopping that's where the machine gun mubo jumbo comes from.

The lesson here, is NEVER point a weapon at someone without having a good reason to.

Johnson threatened his landlord with the AK, who then called the popo.  What did he expect to happen?

We're better off that this guy IS unarmed, unless there's more to the story than we're reading.

I'd venture to guess that it's the typical drama-queen reaction to anything gun-related by the press and local LE.

Wrong

26 USC § 5845 - Definitions

(b) Machinegun
The term “machinegun” means any weapon which shoots, is designed to shoot, or can be readily restored to shoot, automatically more than one shot, without manual reloading, by a single function of the trigger. The term shall also include the frame or receiver of any such weapon, any part designed and intended solely and exclusively, or combination of parts designed and intended, for use in converting a weapon into a machinegun, and any combination of parts from which a machinegun can be assembled if such parts are in the possession or under the control of a person.
