In NY they give out carry permits to everyone. Some counties restrict them so you can only carry your gun to and from the range. If you get caught carrying out side of permit the worst you can get is your permit revoked, no criminal charges. If you don't have a permit and are caught carrying it's a felony.

Before we had a CCW licensing system it was a misdemeanor, now since the system is in place, unlicensed carry is a felony.

Felony in Florida. I have been thinking a lot about this lately.
I came up to Tennessee on vacation and noticed a lot of "NO Firearms" signs in restaraunts where alcohol is served.
This was just recently lifted and you can carry, just not at the bar.
I carry all the time, everywhere I go, except the definite NO NO places and never worry or think about it.
This makes me wonder just how many people actually carry "ILLEGALLY"??
This goes from the standard THUG stereotypes to the average Joe who carries and never gets his CCL.
THe old "Concealed is Concealed" line comes to mind.
It may put people's mind at ease knowing that they are carrying as long as they never need to use it.

So the question is:
Do you think there are a lot of "law abiding citizens" out there that carry a CCW daily without a CCL?

Notice the quotation marks.  They are not law abiding citizens if they carry without a license. They are breaking the law,
unless it is a place that doesnt need a license.

ETA: my apologies to the OP.  I just re-read my post and didnt mean to thread jack.  His question just got me thinking.

Actually, it's an A-misdemeanor.

Penal Law 265.01, CPW4.

Of course, if it's loaded (defined as possessing ammunition of a proper caliber), then it's 265.02, CPW3, which IS a D-felony.

God, our laws are a mess.

Same in Colorado. Not sure about severity, but not a felony.

A lot less penalty than not having a firearm when you need it.

KRS 527.020(9) establishes the following penalty: "Carrying a concealed
weapon is a Class A misdemeanor, unless the defendant has been
previously convicted of a felony in which a deadly weapon was possessed,
used, or displayed, in which case it is a Class D felony."

If the handgun is registered in the state, first time offense, a fine and maybe a few weeks in jail, if it is not it is a felony.
I am willing to pay a fine and spend a few days in jail.

Are you talking about handgun licenses or concealed carry licenses?

Most states don't have "handgun licenses" like New York does.

We have no permit system and carrying gets you a felony in this God forsaken shithole. If it were only a misdemeanor, I'd chance it. As it is, I would go to jail and lose my rights for good.

Felony, 1-5 years.

Odds are several sentences because you need a licnese to possess a gun, license to have 10+ round magazines, and a license to have "ammunition components".

EDIT: For those of you that put down "misdemeanor", how much jail time goes with that?

The Handgun License is the the Permit to carry.  Per NYS Law. The issuing agents (Judges or PD) have a nasty habit of adding thier own restrictions that are administrative only.  IE you carry outside of them and you get your permit revoked but you are not criminally charged

In Michigan, it's a five-year Felony.

750.227 Concealed weapons; carrying; penalty.

Sec. 227.

(2) A person shall not carry a pistol concealed on or about his or her person, or, whether concealed or otherwise, in a vehicle operated or occupied by the person, except in his or her dwelling house, place of business, or on other land possessed by the person, without a license to carry the pistol as provided by law and if licensed, shall not carry the pistol in a place or manner inconsistent with any restrictions upon such license.

(3) A person who violates this section is guilty of a felony, punishable by imprisonment for not more than 5 years, or by a fine of not more than $2,500.00.

If you get a handgun for home defense, never intending to carry it concealed, do you still need a handgun license?

Yes

The License is for both posession of said hand gun and for carry.

You can't touch a pistol without a Pistol License.  You can't just buy a pistol in New York(State)

You have to first get a Pistol License that involves an indepth background check.  After that it gets approved byt he local issuing authority (County Judge) and then you can go buy a pistol.  But you can't have it just then.  YOu have to have it put on your License(S/N, Caliber, Make, Model) then you are given a chit to take to the gun shop and they give you the pistol in exchange for the chit.

Except this is not the rule for all of New York because there is no state wide preemption. So each Judge or PD has thier own little fiefdom that they can rule as they see fit.  While this is a good thing in Rural counties who elect good judges who put no restrictions on permits, it sucks for the guys stuck in urban and sub urban areas who have to deal with libtards

In VA it is a class 1 misdemeanor, 12 MONTHS Max and or $2,500 Fine (for comparison, this is the same as if you falsely pulled a fire alarm at my university)

Nevada: Category C felony.

Punishable by a sentence of imprisonment in the state prison for a minimum term of not less than 1 year and a maximum term of not more than 5 years. In addition to any other penalty, the court may impose a fine of not more than $10,000, unless a greater fine is authorized or required by statute.

I see now.  Most places you don't have to have a license to own a handgun, just if you want to carry it concealed.  Then you have to do the background checks, etc. for the carry license.

In Oregon unlawful possession of a firearm is a class A misdemeanor.

NM: Class 4 misdemeanor, meaning a $50 fine, a mild ass-chewing by the judge, and you get your gun back.

So the question is:

Lots of 'em. And many of those I know seem to think that I am stupid for having my CCW because, now that I know the law, I can be prosecuted for f*****g up. They seem to think they can't get busted if they wrongfully use their gun.

This is Tennessee...I know a lot of people who carry all the time unless they're going through a metal detector.  The "carry in bars" law that people hate so much is not really accomplishing anything other than letting the criminals know that the truly law abiding carriers will now also be carrying at bars.  I wish we were like the lucky guys in AK and AZ though
