As a county parole officer, I've been keenly aware of the DUI laws in PA.
If one is a first time offender and have no prior convictions, one is eligible for the ARD(Accelerated Rehabilitative Disposition)Program and it works like this: One agrees to complete the legislativelyy-mandated Alcohol Safe Driving School and any other recommended treatment, 50 hours of community service, and pay fees and costs, which is determined by the BAC. The license suspension is also determined by BAC, ie: 30 days if the BAC is under .16% and 60 days if the BAC is .16% or greater and no license suspension if the BAC is under .10%. If one completes these requirements, one's record will be expunged, however if these requirements are not met, one's case goes back on the trial list.
If one has a prior record for a misdemeonor or felony and this is the first DUI within a 10 year period one can get 6 months' probation if the BAC is below .10%, however if the BAC is .10% or above then one will get sentenced to a term of incarceration for 72 hrs with 6 months of parole or if one can offord it and if one is statutorily eligible for it, one will get a term of intermediate punishment for 6 months with 18 days on house arrest. The license suspension is one year for people who had a BAC of less than .16%, 18 months if greater than or equal to .16% and no suspension for under .10% BAC
As Far as costs go, and ARD case will cost one about $1500 and a parole/IP case will cost one about $2000.
