Democrats to delay Alito vote

By JESSE J. HOLLAND, Associated Press writer

WASHINGTON -- Democrats confirmed yesterday that they will make a last-ditch attempt to slow Supreme Court nominee Samuel Alito's momentum by delaying the first vote on his candidacy.

Sen. Patrick Leahy, D-Vt., said in the waning minutes of Alito's confirmation hearing that unnamed Democrats will "exercise their rights" to put off next week's scheduled Alito vote in the Senate Judiciary Committee.

That vote would have been Republicans' first chance to officially endorse President Bush's pick to replace retiring Justice Sandra Day O'Connor. All 10 GOP Judiciary Committee members have already announced their support for Alito, a 55-year-old federal appeals judge, former federal prosecutor and Reagan administration lawyer.

The White House yesterday heaped praise on Alito, with spokesman Scott McClellan saying the proceedings showed Americans a man who's "brilliant, honorable and decent, open-minded and fair."

But Democrats say they won't be ready Tuesday to vote on his nomination, since Senate Democratic Leader Harry Reid of Nevada has called on party members to hold off making a decision until after a Wednesday meeting.

The federal government is closed Monday for the Martin Luther King Jr. holiday.

"A number of our members are going to be home for Martin Luther King events this weekend, will not be back on time on Tuesday and so they will exercise their rights" to delay the vote, Leahy said.

Sen. John Cornyn, R-Texas, a Judiciary Committee member, said "a delay for delay's sake would be a petty, partisan move."

Most -- if not all -- of the Senate's 55 Republicans are expected to line up behind Alito.

Judiciary chairman Arlen Specter, R-Pa., predicted that all eight of the committee Democrats would vote against Alito, whenever the vote is held. But on the final Senate vote, "I think there will be a little deviation," he said.

The 44 Senate Democrats have been mostly silent about their intentions, although committee senators like Edward Kennedy of Massachusetts and Charles Schumer of New York have indicated they will oppose Alito's confirmation.

Their liberal supporters plan to work senators hard before the final vote to ensure as many of them as possible vote against Alito, who they say will be likely to swing the court to the right in replacing O'Connor. She provided decisive votes on such important issues as abortion, capital punishment and affirmative action.

Oh, I know the chances are *very* good that he's gonna get the job, I'm just pissed off at the fact they can't do ANYTHING constructive.  So they delay.  What happens?  Nothing but they can hold on to the spotlight just a little longer, keep the wheels turning (and burning OUR tax $$$) for nothing.

Once he's on the court they will learn what it's like when their rights are trampled. Libs know nothing about guns, but feel free to tell us what we should do with them. The demoncraps are allowed to delay the committee vote one week only. Then they have to vote. Delay Senate vote by a week only.  There is an abortion case that was heard by SCOTUS a momth or so ago. If SCOTUS issues a ruling before vote, it will overturn some restrictions. O'Connor will be the swing vote.

If the ruling is not issued before Alito voted in and a 4-4 tie vote occurs, it will be reheard. That is another reason for the delay

All Alito said on the MG case was states can regulate guns and the Congress did not state a clear enough Interstate Commerce reason for controlling MGs. He said if they has stated a good reason,the feds COULD regulate them

This has been a VERY bad week for the DUmocrats.  The really DO look like a bunch of whiney buffoons.  They have applied a double standard to Judge Alito and made frontal assaults and ridiculous demands on him that they never made on their liberal nominees like Ginsburg.  They embarrassed themselves by trying to trash his character and get him upset in front of millions of Americans.  Now...I know that not everyone saw what happened because the MSM failed to report it...but I can ASSURE you that come election time, these buffoons will be center stage.

This delay, while it pisses me off too, means nothing in the long run.  The DUmocrats are still dumpster diving, looking for any scrap of garbage to pin on Judge Alito...and they are desparately trying to buck up their base constitutency...who are ENRAGED beyond belief at the way this has turned out.  If you doubt me, hold your nose and go over to the DU.  They are in an apoplectic fit right now.  Many are screaming that because the Dums aren't willing to invoke a filibuster or simply walk out of congress...or maybe commit murder, they are leaving the Dummy Party for the Greens...or maybe the Dem Socialists or whatever.  

So this is all a silly bit of stagecraft on the part of the committee Dums.  They're going to lose in the end and they know it.  That my friends is why having the majority is so damn important.

Oh...and it really IS all about abortion too.  The rest of the blathering is all merely sidebar bullshit.

THIS is why it was SO critical that Dubya win the last two elections.  These two judges and possibly one or two more appointments are going to change the course of our country.

I think Feinstein, Schumer, Kennedy and the other Dims had their doctors advise them to take their blood pressure meds or they wouldn't be around to vote...on anything.  I'm wondering if any of them will make any appearances for MLK Day or if they'll feign being exhausted from the Inquisition of "Alioto" (guess they wanted to make sure everyone thought he was Italian).

It's not necessarily a pro-2A thing he's doing there.  He could in all likelihood believe the same thing that many others believe regarding the 2A and militias and collective rights.  The case he ruled on had to do with unconsitutional excercise of the commerce clause, which is now pretty much unlimited thanks to Raich.  That was probably the best shot at overturning federal bans.
