The department could be found in contempt if they continue to refuse to return a small amount of marijuana seized from a man after a traffic stop. Municipal Court Judge Jack Emery repeated an order to police Thursday to return the drug to Joseph L. Robertson within seven days or they could be found in contempt.

"Appeal or comply," Emery told assistant city attorney John Walker. "Or next week, show up, and I would advise you to bring counsel."

Alternately they should be required to pay him the value of the marijuana based on what the PD tells people it's worth in press releases.

To comply violates Federal Law.  All they have to do is write that in an appeal and have the DEA show up at the hearing to testify if needed.

The point is, it would be a Federal crime for them to return it.


As pointed out its a federal crime to come into this country illegally however states cant seem to enforce that shit.
So why enforce a federal statute that's been made legal by the state?

Since this crime occurred prior to the state law being enacted the judge should have never indicated he could get the weed back. I think the reason he did was because the guy had a medical card for the weed and it should not have been taken in the first place.

Either way don't piss off the judge, cop or criminal you will get smacked down.
