I'm fairly certain that just about every serious business that exists has to keep at least 5 years worth of Emails, and their back-ups, just in case of a government investigation.

As soon as I read that her emails were lost because her computer crashed, I knew one of two things happened:
1)  The IRS's IT people are the most incompetent imaginable, running no server backups and using POP3 settings, which no one with any sense has used in many years.



2)  Someone who knows nothing about computers told a very stupid lie.
If your IT people have things set up at a 3 or higher on a 1-10 scale of quality, your PC could burn, and you'd lose nothing or almost nothing.  Certainly you'd lose no emails.

As someone who has taught law school classes on discovery of electronic records, I call complete and utter bullshit.  People should be in jail until they cough up these emails.  They DO exist, on a server or a backup tape.

IRS has their email system on an internal cloud storage system spread among servers located at every IRS processing center.  Any suggestion that those emails are really lost is total BS and only absolute fools will believe this blatant lie.  Unfortunately, there are a lot of fools running loose in the USA these days.

The rule of law is now only for you and me.
This would be called "tampering with evidence", "withholding evidence" and "destruction of evidence" if it were you or I.
Throw in contempt of Congress and all of them involved in this conspiracy (as a prosecutor would call it) would have been looking at 30 year federal prison sentences on just this alone back when the rule of law applied to everyone especially those who were entrusted to serve us.
These charges would be filed along with the "abuse of official power", "corruption" and "conspiracy" charges, they could even charge them with criminal use of a communication device, something commonly use against drug dealers.
All would be used against anyone outside the protected class.
BTW, that info they are saying is "lost" is easily obtainable from government back up computers, ISP's or even the NSA if a subpoena is requested.
