LINCOLN, Neb. - A judge has thrown out a Nebraska legislator's lawsuit against God, saying the Almighty wasn't properly served, because of his unlisted home address. State Sen. Ernie Chambers filed the lawsuit last year seeking a permanent injunction against God.

He said God has made terroristic threats against the senator and his constituents in Omaha, inspired fear and caused "widespread death, destruction and terrorization of millions upon millions of the Earth's inhabitants."

Chambers has said he filed the lawsuit to make the point that everyone should have access to the courts regardless of whether they are rich or poor.

On Tuesday, however, Douglas County District Court Judge Marlon Polk ruled that under state law a plaintiff must have access to the defendant for a lawsuit to move forward.

"Given that this court finds that there can never be service effectuated on the named defendant this action will be dismissed with prejudice," Polk wrote.

Hole in the judge's ruling?
Chambers, who graduated from law school but never took the bar exam, thinks he's found a hole in the judge's ruling.

"The court itself acknowledges the existence of God," Chambers said Wednesday. "A consequence of that acknowledgment is a recognition of God's omniscience."

Therefore, Chambers said, "Since God knows everything, God has notice of this lawsuit."

Chambers has 30 days to decide whether to appeal. He said he hasn't decided yet.

Chambers, who has served a record 38 years in the Nebraska Legislature, is not returning next year because of term limits. He skips morning prayers during the legislative session and often criticizes Christians.

Ol" Ernie will meet God in the "courtroom" all right, it's just that God will be the Judge, not the defendant.

Prison will be quite hot and miserable.

I'm blown away that he's managed to get re-elected so many times that he's reached the end of his term limits.

Is the majority of Omaha that stupid?

BTW- isn't there something that can be done about his frivolous lawsuits? He's wasting taxpayer money.

He didn't reach term limits, term limits were enacted because of him.

State Sen. Ernie Chambers should sue his parents.

Actually, his is a wasted LIFE. There are few that've gone off the deep end like good ol' Ernie. He was so off-the-wall, he provided entertaiment for most of us.

When he meets his maker he'll have the opportunity to properly serve his summons to appear in court.

I seem to remember this being a publicity stunt highlighting frivolous lawsuits. Maybe the guy is crazy, but assuming my memory is correct, he kinda does have a point.

Does somebody have to be served directly or can they be served at their residence?

Strictly speaking a church is the House of the Lord(tm) and preachers, pastors, etc are his duly appointed representatives.

Hmmmm. In "sam gunn forever" ben bova wrote about someone suing the pope over acts of god. it basically stated that the pope is and always will be gods intermediary here on earth and can stand in his stead. so why cant crazy lawyer dude list the pope as gods duly acting representative. I mean geez the catholics been telling us for 500 years that the pope is gods right hand man. let him feel the downside too.

Anybody remember the George Burns movie, "Oh, God"? God (George Burns) goes to court; he swears to tell the truth, the whole truth, and nothing but the truth, "so help me me."

Some guy---a politician no less----actually tried to sue God?

Oh well, I might as well go ahead and add this:

He should have tried to have God served by publication.

If he really wanted to find God all he had to do was go to the local jail. I bet you at least 85% of the people in jail found God there or they will find him by the time the get to court.

Jails = Amazing ability to find God

Jails = World's greatest employment office. Nobody sitting in jail trying to get a bond is unable to find employment if released. They all have a job lined up if you only let them out.

So why is the suit without merit?

If God exists and his established residence is the church what's the problem?

What is the legal procedure when someone fails to appear when service has been made to one's residence to a responsible adult?

Send it to the Pope. He claims he is God's earthly rep...

how about the whole article:
'God knows everything'

Mr Chambers sued God last year. He said God had threatened him and the people of Nebraska and had inflicted "widespread death, destruction and terrorisation of millions upon millions of the Earth's inhabitants".

He said he would carefully consider Judge Polk's ruling before deciding whether to appeal.

The court, Mr Chambers said, had acknowledged the existence of God and "a consequence of that acknowledgement is a recognition of God's omniscience".

"Since God knows everything," he reasoned, "God has notice of this lawsuit."

Mr Chambers, a state senator for 38 years, said he filed the suit to make the point that "anyone can sue anyone else, even God".

Well, it's only fair that if the church wants to meddle in temporal affairs such as politics that politics should be able to reciprocate.

And I fail to see the off-the-rockerness, y'all should be glad he seems to think God is real.
