Why isn't he in trouble for shooting the guy in the back? While RUNNING AWAY!! I know he has been deadly and violent in the past, but he was running away and not threatening the officer at the time. He should have been tazed or something. I know that if Joe Blow saw the guy and he took off running away, and Joe shot him, he would be a criminal! Yes, I already know the answers.....it was a cop doing the shooting....he had killed a cop before....he was white so it doesn't matter...
I am just tired of everybody calling him a hero while the other cop that shot the black man in the back is admonished. I do get it though. I wish all cops could and would do what he did in that situation. But in our legal system, a cop can't be judge, jury, and executioner. He can't (Legally) see the guy, watch him run and then shoot to stop him!! I didn't want to find the other threads so I don't care if this is a dupe. I am just wondering aloud about the hypocrisy of the media and others. |

Probably because fleeing felon that was known to be a danger to the public.

OP, you are wrong on this one... even you, as a citizen, can kill someone fleeing arrest if you have reason to beleive that person will commit violence and that you have to stop them from committing that violence.. any reasonable jury would conclude that the BG would stop at nothing to evade capture and killing / maiming would occur if he is not stopped. I say good shoot.

He is a fleeing convicted murderer who escaped from prison.
Shoot him in the back, shoot him in the front, shoot him in the ass. It's all good. Eta: All he did was accelerate his execution, if He dies. |

I think its more than a fleeing Felon. Fleeing felon is someone that has committed a felony But hasn't been convicted of such crime.
Escaped prison felon is much worse I think and probably can be shot on sight if resisting. |

Anyone hear the distance of the shot? Think on one of the cable channels they said it was over hundred yards with a handgun.

The cop is a hero. And a good shot. Took a man down on the run with two COM hits at distance with a pistol. Not many people can do that.
ETA - As mentioned already, Tennessee v. Garner. I am sure anyone involved in the manhunt was thoroughly apprised of the legality of shooting both of those scum. |

He can be forced to do labor and has a reduction in rights. A person that just committed a crime or is in custody and not convicted, is completely different. You have 2 different rules for capturing or recapturing the different categories. |

Trooper Sergeant is a Firearms Instructor and is a master at applying case law. Please show me the case law that prohibits shooting armed, fleeing felons in the back? |

Fleeing felon who was refusing to obey commands is a legal shoot. Especially a currently supposed-to-be-incarcerated one.

Any escapee (felon) that does not comply instantly you drop the hammer on them. Running away even more so. That's sorta the whole point.
The only two objects of a manhunt is to: (1) Protect the public from the escaped felon. (2) Capture escaped felon. Alive was fine, dead or wounded was OK too. There is no consideration at all for the escaped convict. No warning shot or shit like that. The convict has to comply instantly to your commands or be ventilated. We were trained to shoot them center of mass. Usually one round of #4 buck took care of things. If they survived then fine, if they bled-out before help arrived then they died. Once the convict was on the ground you were not to render any assistance, you did nothing but cover him till help arrived. If the convict lived you went to court to give him more time. If he died you simply never heard anymore about it on a official basis. |
